No. 06-0059\n1630 Port Blvd.\nSeaboard Marine, Ltd.\nPort\nof Miami\nMiami, Florida\n33132\nDear Mr. Plasencia:\nThis responds to your letter requesting clarification of\nthe rolling stock stowage requirements under the Hazardous\nMaterials Regulations (HMR; 49 CFR Parts 171-180) .\nYour\nquestions are paraphrased and answered as follows:\nMust rolling stock be literally \"rolled-on\" or\nvehicles in order to be eligible for the exceptions in\n\"rolled-off\" a RO/RO vessel that is specially suitable for\n§ 176.905 (i)?\nA1.\nRolling\nstock does\n\"rolled-off\" the vessel. Section 176.905 (i) (3) is a\nstowage requirement; the compartment or hold must be\nto cong mant a mol that be\nspecially suited for vehicles in accordance with 46 CFR\n70.10-1 or 90.10-38, as appropriate.\n38, as approprate ne equitement does\nnot address loading/unloading operations.\nFor example, a bulldozer on a flatbed trailer loaded in a\ncompartment or hold that is specially fitted for vehicles\nis eligible for the exception in 49 CFR 176.905(i) (3;\nvehicle in a freight container stowed in a compartment or\nprovided the equipment is suitably secured. However, a\nhold that is specially suited for vehicles is not eligible\nA freight container is an enclosed\nspace and,\nin the event of a fuel leak, can collect vapors\nand create\nexplosive atmosphere within the container.\n02.\nIs an automobile stag:d for transportation in a port\narea subject to the HMR if it meets the conditions for\nexception from the HMR in § 176.905 (i) ?\n176-1\n060059\n176.905\n\n<<<PAGE 2>>>\n\nA2. My understanding is that this sub-paragraph facilitates Roll-on/Roll-off designated vessels. Therefore, a\ndeck of a RO/RO vessel, does it still meet this exception? What if it is an automobile either on an open\nflatbed unit or inside a freight container, loaded on the top deck?\n2. If a vehicle shipment is booked as non-hazardous due to the fact that it meets one of the exceptions found\nin 176.905, then is it still subject to the HMR while staged on our waterfront facility (i.e. 1/4 tank of gas or\nless, key out of the ignition, etc.)?\nThank you in advance for your guidance in this matter.\nBest regards,\nJohn P.
