Box 30438\nBethesda, MD 20814\nDear Mr. Smith:\nOffice of Hazardous Materials Enforcement concerning marking\nThis responds to your email sent to Mr. Robert Lynch in the\nrequirements for packages containing Fireworks, UN0336,\n1.4G, under the Hazardous Materials Regulations (HMR; 49 CFR\noffice for a response.\nParts 171-180). Your inquiry has been forwarded to this\nSpecifically, you indicate that the name \"Consumer\nFireworks\" is routinely marked on packages of fireworks.\nYou enclosed a photograph showing a typical marking and ask\nif this marking is acceptable under the marking requirements\nThe HMR specify that the\nproper shipping name and identification number marked on a\nMaterials Table\npackage must be as shown in the § 172.101 Hazardous\n(see § 172.301 (a) (1)) and must be located\neffectiveness\naway from any other\n{see § 172.304 (a) (4)). The marking displayed\nmarking that could reduce its\non the package in the photograph does not satisfy these\nname shown in the § 172.101 Hazardous Materials Table.\nrequirements.\n\"Consumer Fireworks\" is not a proper shipping\nFurther, the additional wording \"Consumer\" may reduce the\nclarity of the required marking.\n172.101\n060166\n173.62\n\n<<<PAGE 2>>>\n\nIt is our recommendation that if your members want to\ncontinue using the name \"Censumer Fireworks\" as a package\nmarking for purposes other than compliance with the HMR, the\nmarking should be located away from the proper shipping\nand identification number markings.\nwe can be of\nI trust this satisfies your inquiry.\nPlease contact\nus if\nfurther assistance.\nSincerely,\nlicwand 3.
