DuPont de Nemours & Co\nAxis, Alabama 36505\nDear Mr. Greene:\nThis is in response to your request for a clarification of the packaging notification\nrequirements in Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).\nSpecifically, you ask if the packaging notification requirements in § 178.2(c)(1)(i) apply to\ncylinders.\nThe answer is no. Section 178.2(c)(1)(i) requires written notification to each person to whom\na packaging is transferred of all Part 178 requirements not met at the time of transfer. A\ncylinder manufactured under Part 178, Subpart C must be in full conformance with all\nspecification requirements at the time of transfer. The cylinder manufacturer certifies that\nthese requirements have been met by marking the applicable DOT specification marking on\nthe cylinder, eg. DOT-3A, DOT-4BW. Additionally, the cylinder inspector is responsible for\nensuring each cylinder made is in full conformance with all specification requirements. See\n§ 178.35 (c) of the HMR.\nIn addition, you refer to a December 1, 2005 interpretation letter (Ref. No.: 05-0209) from\nthis office in which we specify that paragraph (c) should include a reference to § 178.338-19\nand that current reference to § 178.345-10 should be replaced with § 178.345-15. You ask\nwhen we plan to implement these corrections. We are currently considering revisions to the\ncargo tank specifications and plan to include these corrections in that rulemaking.\nI hope this information is helpful. However,\nthe letter did not tnention if the notification requirements in 178.2 are applicable to cylinders.\nThe notification requirement in 178.2 (c)(l)(i) calls for notification if there is a requirement in this part\n(i.e., Part 178) that is not met at the time of transfer. To the best of my knowledge, there is no sucb\nrequirement in part 178 for cylinders. With that said, is the notification requirement in 178.2 of the\nHazardous Materials Regulations (HMR; 49 CFR P a . 17 1-1 80) applicable to cylinders?\nAdditionally, PHMSA co~nmunicated in its letter that the current reference to 178.345. I0 in paragraph (c)\nis in error and should read 178.345-15. Also, the reference for MC-338 cargo tank certification in 178.338-\n19 is missing. PIease advise when PHMSA expects to correct the aforementioned errors in the HMR?\nI hope this information is helpful.
