Bugg:\nThis responds to your request for clarification of the requirements pertaining to the use of trade\nnames and common names under the Hazardous Materials Regulations (HMR; 49 CFR Parts\n171-1 80). You state that a cargo tank is marked with the trade name \"Emixal\" followed by\n\"Refrigerated gas\" and that the shipping papers contain the shipping description, \"Gas,\nrefrigerated liquid, n.o.s., (Argon, Oxygen), 2.2, UN3 158\" without the trade name in association\nwith the basic description. Specifically, you ask whether the use of the trade name as a common\nname and used in this manner is acceptable under 5 172.328(b)(2).\nYou submitted for our review copies of the shipping paper, materials safety data sheet and a\nphotograph of the cargo tank marking. The photograph shows a cargo tank marked as follows:\nEMIXAL\nREFRIGERATED LIQUID\nSection 172.328(b)(2) provides for a common name to be marked in place of the proper\nshipping name on a cargo tank. Neither the description \"Refrigerated Liquid\" nor \"Emixal,\nRefrigerated Liquid\" is an acceptable common name for the subject gas mixture and, therefore,\ndoes not satisfl the marking requirement in 5 172.328(b)(2). Emixal appears to be a trade\nname. Under 5 172.304(a)(4), non-required markings, such as a trade name, would be\nacceptable if displayed away from the required hazard markings in a manner that does not\nsubstantially reduce its effectiveness.\nWhen a common name is used to meet the marking requirements for a cargo tank, that action\ndoes not affect the shipping paper requirements. The assigned basic shipping description \"Gas,\n\n<<<PAGE 2>>>\n\nrefrigerated liquid, n.o.s., (Argon, Oxygen), 2.2 UN3 158\" is correct. The notation of a common\nname on the shipping papers would be considered additional information and may be included\non the shipping paper in accordance with 5 172.203.\nI hope this information is helpful. HAZARD IDENTIFICATION\nI EMERGENCY OVERVIEW: This is a colorless, odorless, cryogenic liquid mixture. The cryogenic liquid will\nof this gas is asphyxiation, by displacement of oxygen. The liquefied gas can also cause freezing of tissue., or I\nrapidly boil to the gas at standard temperatures and pressures. A primary health hazard associated with releases\nI crvoaenic burns, similar to frostbite to eves or skin upon contact. 1\n-\nSYMPTOMS OF OVEREXPOSURE BY ROUTE OF EXPOSURE: The most significant routes of overexposure for\nthis gas are by inhalation, and contact with the cryogenic liquid.\nINHALATION: High concentrations of this gas can cause an oxygendeficient environment. Individuals breathing\nsuch an atmosphere may experience symptoms which include headaches, ringing in ears, diuiness, drowsiness,\nunconsciousness, nausea, vomiting, and depression of all the senses. The skin of a victim of overexposure may\nhave a blue color.\nUnder some circumstances of overexposure, death may occur, due to the displacement of oxygen. The following\neffects associated with various levels of oxygen are as follows:\nCONCENTRATION SYMPTOM OF EXPOSURE\n12-16% Oxygen: Breathing and pulse rate increased, muscular coordination slightly disturbed.\n1 0-1 4% Oxygen: Emotional upset, abnormal fatigue, disturbed respiration.\n6-1 0% Oxygen: Nausea and vomiting, collapse or loss of consciousness.\nBelow 6%: Convulsive movements, possible respiratory collapse, and death.\nCONTACT WITH SKIN or EYES: Contact of the liquid with the skin can lead to severe cryogenic burns or dermatitis\n(red, cracked, irritated skin), depending upon concentration and duration of exposure. Contact of the liquid with the\neyes can cause pain, redness, severe cryogenic burns, and prolonged exposure could cause blindness. Contact\nwith the undiluted liquid will cause frostbite, ulceration of the skin (which may be delayed in appearance for\nseveral hours), blistering, and pain. Contact with rapidly expanding gas poses a frostbite hazard.\nOTHER POTENTIAL HEALTH EFFECTS: Contact with cryogenic liquid or rapidly expanding gases (which are\nreleased under high pressure) may cause frostbite. Symptoms of frostbite include change in skin color to white or\ngrayish-yellow. The pain after contact with liquid can quickly subside.\nHEALTH EFFECTS OR RISKS FROM EXPOSURE: An Explanation in Lay Terms. Over-exposure to this\nrefrigerated gas mixture may cause the following health effects:\nACUTE: The most significant hazard associated with this gas is inhalation of oxygendeficient atmospheres.\nSymptoms of oxygen deficiency include respiratory dficulty, ringing in ears, headaches, dizziness, indigestion, and\nnausea. At high concentrations, unconsciousness or death may occur. Contact with cryogenic liquid or rapidly\nexpanding gases (which are released under high pressure) may cause frostbite. Symptoms of frostbite include\nchange in skin color to white or grayish-yellow. The pain after contact with liquid can quickly subside.\nCHRONIC: There are currently no known adverse health effects associated with chronic exposure to this\nrefrigerated gas mixture.\nTARGET ORGANS: Respiratory system.\n3. COMPOSITION and INFORMATION ON INGREDIENTS 1\nThis material is classified as hazardous under OSHA regulations in the United States and the WHMlS in\nCanada.\nNE = Not Established C = Ceiling Limit See Section 16 for Defin~tions of Terms Used.\nNOTE: all W M l S required informatlon is included. At a minimum, Self-\nContained Breathing Apparatus should be worn.\nRemove victim(s) to fresh air, as quickly as possible. If not breathing give artificial respiration If breathing is difficult,\ngive oxygen Only trained personnel should administer supplemental oxygen.\nSKIN EXPOSURE: Remove any clothing that may restrict circulation to any frozen area. Do not rub frozen parts as\ntissue damage may occur. As soon as practicable, place any affected area in warm water bath which has a\ntemperature that does not exceed 105°F (40°C). NEVER USE HOT WATER. NEVER USE DRY HEAT. If area of\nfrostbite is extensive, and if possible, remove clothing while showering with warm water. If warm water is not\navailable, or is impractical to use, wrap the affected parts gently in blankets. Alternatively, if the fingers or hands are\nfrostbitten, place the affected area of the body in the armpit. Encourage victim to gently exercise the affected part\nwhile being warmed. Seek immediate medical attention.\nFrozen tissue is painless and appears waxy, with a possible yellow color. Frozen tissue will become swollen, painful\nand prone to infection when thawed. If the frozen part of the body has been thawed by the time medical attention\nhas been obtained, cover the area with a dry sterile dressing and a large bulky protective covering.\nEYE EXPOSURE: If liquid is splashed into eyes, or if irritation of the eye develops after exposure to liquid or gas,\nopen victim's eyes while under gentle running water. Use sufficient force to open eyelids. Have victim \"roll\" eyes.\nMinimum flushing is for 15 minutes. Seek medical assistance immediately, preferably an ophthalmologist.\nVictim(s) must be taken for medical attention. Rescuers should be taken for medical attention, if necessary. Take\ncopy of label and MSDS to physician or other health professional with victim@).\n5. FIRE-FIGHTING MEASURES\nAUTOIGNITION TEMPERATURE: Not applicable.\nFLAMMABLE LIMITS (in air by volume, %):\nLower (LEL): Not applicable.\nUpper (UEL): Not applicable.\nFlRE EXTINGUISHING MATERIALS: Non-flammable, cryogenic gas. Use extinguishing media appropriate for\nsurrounding fire.\nRESPONSE TO FlRE INVOLVING CRYOGEN: Cryogenic liquids can be particularly dangerous during fires\nbecause of their potential to rapidly freeze water. Careless use of water may cause heavy icing. Furthermore, the\nrelatively warm water greatly increases the evaporation rate of this cryogenic liquid mixture. If large concentrations\nof this refrigerated gas mixture gas are present, the water vapor in the surrounding air will condense, creating a\ndense fog that may make it difficult to find fire exits or equipment. This refrigerated gas mixture, when exposed to the\natmosphere, will produce a cloud of icebog in the air upon its release.\nUNUSUAL FlRE AND EXPLOSION HAZARDS: This gas mixture does not burn; however, containers, when\ninvolved in fire, may rupture or burst in the heat of the fire. This refrigerated gas mixture when accidentally released\nwill vaporize rapidly, forming an oxygen deficient vapor cloud. Evacuate this vapor cloud area. Visibility may be\nobscured in its vapor cloud. Pressure in a container can build-up due to heat and ~t may rupture if pressure relief\ndevices should fail to function. Contact with cold liquid or gaseous mixture may cause frostbite.\nExplosion Sensitivitv to Mechanical Impact: Not Sensitive.\nExplosion Sensitivity to Static Discharqe: Not Sensitive.\nSPECIAL FIRE-FIGHTING PROCEDURES: Structural fire-fighters must wear Self-Contained Breathing Apparatus\nand full protective equipment. If possible, remove cryogenic containers from fire area or cool with water. Do not direct\nwater spray at the container vent. Evacuate area. ACCIDENTAL RELEASE MEASURES\nI I\nRESPONSE TO CRYOGENIC RELEASE: Clear the affected area and allow the liquid to evaporate and the gas to\ndissipate. After the gas is formed, follow the instructions provided below. Alternatively, to increase the rate of\nvaporization, spray large amounts of water on to the leak from an upwind position. If the area must be entered by\nemergency personnel, SCBA, leather or insulated gloves, and safety shoes must be worn. Personnel responding\nto a release must avoid all contact with the liquid.\nMinimum Personal Protective Equipment should be Level B: leather or thermally insulated gloves and Self-\nContained Breathing Apparatus. Locate and seal the source of the leaking gas. Monitor the surrounding area for\noxygen level. The atmosphere must have at least 19.5 percent oxygen before personnel can be allowed in the area\nwithout Self-Contained Breathing Apparatus.\nIf leaking incidentally from the container or valve, contact your suppler.\n7. HANDLING AND STORAGE\nWORK PRACTICES AND HYGIENE PRACTICES: Be aware of any signs of dizziness or fatigue; exposures to\nfatal concentrations of this refrigerated gas mixture could occur without any significant warning symptoms, due to\noxygen deficiency.\nSTORAGE AND HANDLING PRACTICES: Cryogenic containers should be stored in dry, well-ventilated areas\naway from sources of heat, ignition and direct sunlight. Keep storage area clear of materials which can burn. Store\ncontainers away from heavily trafficked areas and emergency exits. Store away from process and production areas,\naway from elevators, building and room exits or main aisles leading to exits. Protect containers against physical\ndamage.\nContainers should be stored upright and be firmly secured to prevent falling or being knocked-over. Containers can\nbe stored in the open, but in such cases, should be protected against extremes of weather and from the dampness\nof the ground to prevent rusting. Cryogenic containers are equipped with pressure relief devices to control internal\npressure. Under normal conditions, these containers will periodically vent small amounts of product. Some metals\nsuch as carbon steel may become brittle at low temperatures and will easily fracture. Prevent entrapment of liquid in\nclosed systems or piping without pressure relief devices. Use a check valve or other protective device in the\ndischarge line to prevent hazardous backflow. Never tamper with pressure relief valves and containers.\nKeep the smallest amount on-site as is necessary. Full and empty containers should be segregated. Use a first-in,\nfirst-out inventory systems to prevent full containers from being stored for long periods of time.\nSPECIAL PRECAUTIONS FOR HANDLING CRYOGENIC CONTAINERS: Cryogenic liquids can present\nsignificant safety hazards. Never allow any unprotected part of the body to touch uninsulated pipes or vessels which\ncontain cryogenic fluids. The extremely cold metal of the container will cause the flesh to stick fast and tear when\none attempts to withdraw from it. The following rules are applicable to work situations in which cryogenic containers\nare being used.\nBefore Use: Move containers a suitable hand-truck. Do not drag, slide or roll containers. Do not drop containers or\npermit them to strike each other. Secure containers firmly.\nDuring Use: Use designated CGA fittings and other support equipment. Do not use adapters. Do not heat\ncontainer by any means to increase the discharge rate of the product from the container. Do not use oils or grease\non valve fittings or equipment. Leak-check system with leak detection solution. Immediately contact the supplier if\nthere are any difficulties associated with operating container valve.\nAfter Use: Close main container valve. Mark empty container \"EMPTY\".\nNOTE: Use only DOT or ASME code containers designed for gas storage. Close valve after each use and when\nempty. Containers must not be recharged except by or with the consent of owner. For welding and brazing\n' operations, refer to ANSI 2-49.1 \"Safety in Welding and Cutting\" and OSHA safety regulations for welding, cutting,\nand brazing (29 CFR 191 0.252). Refer to Section 16, Other Information, for additional available literature.\nOTHER SPECIAL PRECAUTIONS: Use piping and equipment adequately designed to withstand pressures and\ntemperatures to be encountered. Use a check valve or other protective apparatus in any line or piping from the\ncontainer to prevent reverse flow. To prevent cryogenic liquids or cold gas from being trapped in piping between\nvalves, the piping shall be equipped with pressure relief devices. Only transfer lines designed for cryogenic liquids\nshall be used. HANDLING AND STORAGE (Continued) I\nI I\nSTANDARD VALVE CONNECTIONS FOR U.S. AND CANADA: Use the proper CGA connections, DO NOT\nUSE ADAPTERS:\nTHREADED: CGA 295\nPIN-INDEXED YOKE: Not applicable.\nULTRA HIGH INTEGRITY: Not applicable.\nPROTECTIVE PRACTICES DURING MAINTENANCE OF CONTAMINATED EQUIPMENT: Follow practices\nindicated in Section 6 (Accidental Release Measures). Make certain application equipment is locked and tagged-out\nsafely. Always use product in areas where adequate ventilation is provided.\nI 8. EXPOSURE CONTROLS - PERSONAL PROTECTION I\n-\n~ --\nVENTILATION AND ENGINEERING CONTROLS: Use with adequate ventilation. Local exhaust ventilation is\npreferred, because it prevents chemical dispersion into the work place by eliminating it at its source. If appropriate,\ninstall automatic monitoring equipment to detect the level of oxygen.\nRESPIRATORY PROTECTION: Maintain oxygen levels above 19.5% in the workplace. Use supplied air\nrespiratory protection if oxygen levels are below 19.5% or during emergency response to a release of this\nrefrigerated gas mixture. If respiratory protection is required, follow the requirements of the Federal OSHA\nRespiratory Protection Standard (29 CFR 191 0.134), or equivalent State standards.\nEYE PROTECTION: ~ u l l faceshield and safety glasses are recommended.\nHAND PROTECTION: Wear loose-fitting, thermally insulated or leather gloves. Otherwise, wear glove protection\nappropriate to the specific operation for which this refrigerated gas mixture is used.\nBODY PROTECTION: Use body protection appropriate for task. Safety shoes are recommended when handling\ncontainers, as well as long sleeve shirts and trousers.\n9. Male rats were exposed for 6 days to 20% oxygen and 80°h Argon at 1\natmosphere ambient pressure. No significant changes in blood cell counts or bone marrow were observed. Other animal studies\nconcern the deficiency of (hypoxia) or the narcotlc effects of various pressures of Argon, the effects of increased Argon pressures on\nthe central nervous system and decompression sickness. Eyes: Argon gas injected into the anterior (front) chamber of the eyes of\nrabb~ts caused no injury and was reabsorbed at about the same rate as air.\nOXYGEN:\nCytogenetic Analysis System (hamster lung) 80 pph\nTCLo (inhalation-woman) 12 pph for 10 minutes. Teratogenic effects.\nTCLo (inhalation-human) 100 pph for 14 hours. Pulmonary effects.\nSUSPECTED CANCER AGENT: The components of this refrigerated gas mixture is not found on the following lists:\nFEDERAL OSHA Z LIST, NTP, CAUOSHA, IARC, and therefore is not considered to be, nor suspected to be a\ncancer-causing agent by these agencies.\nIRRITANCY OF PRODUCT: Contact with the cryogenic liquid or rapidly expanding gases can cause frostbite and\ndamage to exposed skin and eyes.\nSENSITIZATION OF PRODUCT: The components of this refrigerated gas mixture are not sensitzers after\nprolonged or repeated exposures.\nREPRODUCTIVE TOXICITY INFORMATION: Listed below is information concerning the effects of this refrigerated\ngas mixture on the human reproductive system.\nMutagenicity: This cryogenic liquid mixture is not expected to cause mutagenic effects in humans.\nEmbryotoxcity: This cryogenic liquid mixture is not expected to cause embryotoxic effects in humans.\nTeratoqenicity: This cryogenic liquid mixture is not expected to cause teratogenic effects in humans.\nReproductive Toxicitv: This cryogenic liquid mixture is not expected to cause adverse reproductive effects in\nhumans.\nA mutaaen is a chemical which causes permanent changes to genetic material (DNA) such that the changes will propagate\nthrough generation lines. An embryotoxin is a chemical which causes damage to a developing embryo (i.e. within the first eight\nweeks of pregnancy in humans), but the damage does not propagate across generational lines. A teratoaen is a chemical which\ncauses damage to a developing fetus, but the damage does not propagate across generational lines.
