No.: 08-0233\nDear Mr. Guttemberg:\nThis responds to your letter regarding the requirements governing the transportation of\nradioactive materials and information on the process of starting a transportation company to\ncarry hazardous materials in commerce.\nThe Hazardous Materials Regulations (HMR) is found in Title 49, Code of Federal\nRegulations, Parts 100-1 85. As provided in 49 CFR 171.1, the HMR apply to any\ndepartment, agency or instrumentality that transports or causes to be transported or shipped\nhazardous materials in interstate, intrastate, and foreign commerce, by all modes of\ntransportation (i.e., highway, rail, air, and vessel). The HMR contain classification,\npackaging, shipping papers, labeling, placarding, emergency response information, training,\nregistration, security awareness, and security plans requirements. The HMR can be\naccessed through our Web Page site: http:llwww.phmsa.dot.~ov/hazmat/re~s.\nSpecific requirements applicable to the shipment of radioactive materials are found in\nSubpart I of Part 173 of the HMR. The HMR also contain modal requirements applicable\nto rail, air, vessel and highway carriers in Parts 174, 175, 176 and 177, respectively. In\naddition, the regulations under Parts 390-397 of the Federal Motor Camer Safety\nAdministration (FMCSA) apply to hazardous materials shipped by highway.\nI hope this information is helpful.
