Specifically, you request a letter\nconfirming your conclusion that effective October 1,2009 all \"small\" lithium ion batteries\nmust pass the tests outlined in Section 38.3 of the LlN Manual of Tests and Criteria.\nYour understanding is correct. On August 9,2007, the Pipeline and Hazardous Materials\nSafety Administration amended the HMR to enhance the safe transportation of lithium\nbatteries (HM-224C & HM-224E; 72 FR 44929). As described in 5 172.102, Special\nProvision 188 applicable to small lithium cells and batteries, effective October 1,2009,\neach cell or battery must be of a type proven to meet the requirements of each test in the\nUN Manual of Tests and Criteria.\nI trust this satisfies your inquiry.
