No. 10-0050\nDear Ms. Finkenkeller:\nThis responds to your February 22, 2010 email requesting clarification of the Hazardous\nMaterials Regulations (HMR; 49 CFR Parts 171-180) regarding quantity limitations and cargo\nlocation for carriage by aircraft under § 175.75 and United States (U.S.) Variation 13 in the\nInternational Civil Aviation Organization (ICAO) Technical Instructions. Specifically, you\nrequest clarification on the 75 kg net weight limitation of Division 2.2 materials stowed in an\ninaccessible manner as it applies to articles.\nFor each package containing a hazardous material acceptable for carriage aboard passengercarrying\naircraft, no more than 25 kg (55 pounds) net weight of hazardous material may be\nloaded in an inaccessible manner. In addition to the 25 kg limitation above, an additional 75 kg\n(165 pounds) net weight of Division 2.2 (non-flammable compressed gas) may be loaded in the\nsame compartment. In the case of articles containing a Division 2.2 material, the 75 kg net\nweight limit applies to the amount of hazardous material contained in the article.\nI hope this answers your inquiry. The issue is whether the term\n\"net weight of hazardous materials\" would apply to the gas or to the pneumatic articles.\nCould you find out from the shipper the total content in grams of the gas only? I am\nhopeful that we can resolve this by agree that the gas content is the net weight we\nare concerned with likely the net weight of gas is < 75 kg. In my view the clear\nintent of the Regulations is to limit the quant of material and not count the package\nweight - for example a shipment of Nitrogen in cylinders would be limited based on the\nnet weight of Nitrogen.
