D.C. 20590\nSfP 1 3 2010\nMr. James V. McManus\nSr. Project Manager\nImplant Technologies\n7 Commerce Drive\nDanbury, CT 96810\nRef. No. 10-0167\nDear Mr. McManus:\nThis responds to your July 26,2010 request for clarification on the Hazardous Materials\nRegulations (HMR; 49 CFR Parts 171-180). According to your letter and subsequent telephone\nconversation with a member ofmy staff, you are going to ship \"UN 3383, Toxic by inhalation\nliquid, flammable, n.o.s.,\" using packaging authorized in §173.226. Specifically, you ask ifyou\nmay use selective testing variation 2 in § 178.601(g)(2) to exclude testing ofthe inner packaging\nsystem as normally required in § 173.226(c)(3)(ii).\nThe answer to your question is no. In accordance with 178.601 (g)(2), selective testing of\ncombination packaging variation 2 provides relief from performance testing for outer packaging of\ncombination packaging when inner packaging differ in minor respects from the tested pack~ging\nconfiguration. Variation 2 applies to inner packaging that are not themselves subject to\nperformance testing. Section 173.226(c)(3)(ii) requires the inner packaging system to meet the drop\ntest, leakproofness test, and hydrostatic pressure performance tests ofpart 178 subpart M at the\nPacking Group I performance level. Additionally, the outer packaging ofthe non-bulk combination\npackaging must also conform to the performance test requirements of subpart M ofpart 178 at the\nPackaging Group I performance level. As a result ofthe specific requirements for your packaging,\nyou may not use variation 2 to exclude performance testing ofthe inner packaging system required\nby § 173.226(c)(3)(ii).\nI hope this answers your inquiry. If you need additional assistance, please contact this Office at\n202-366-8553.\nSincerely,\nBen Supko\nActing Chief, Standards Development\nOffice ofHazardous Materials Standards\n\n<<<PAGE 2>>>\n\n'Drakeford, Carolyn (PHMSA)\nFrom: INFOCNTR (PHMSA) -§/7Z./0/\nSent: Tuesday, July 27,20109:18 AM\nTo: Drakeford, Carolyn (PHMSA) lesf-iY)~\nCc: DerKinderen, Dirk (PHMSA) \n IO-lJJl!\"\nSubject: FW: Request for Interpretation\nCarolyn,\nSee below, yet another request for a formal written letter of interpretation.\n-Rob\nFrom: jmcmanus@atmi.com [mailto:jmcmanus@atmi.com]\nSent: Monday, July 26, 2010 5:04 PM\nTo: INFOCNTR (PHMSA)\nSubject: Request for Interpretation\nTo Whom it May Concern:\nI request an interpretation on the following situation in order to answer the question below:\n1. The material of interest is UN3383, Toxic by inhalation liquid, flammable, n.o.s.\n2. The packaging authorization for UN3383 is CFR 49 173.226.\n3. The packaging we are using is a non-bulk combination packaging.\n4. The inner packaging system consists of:\na. A helium leak tight 1.3 liter stainless steel container that contains the UN3383 liquid.\nb. A 5 gallon leak tight drum certified to UN1A2 is the second part of the inner packaging\nsystem that contains the 1.3 liter stainless steel container.\nMy question pertaining to the above hazardous material and the associated packaging authorization\nis as follows:\nCan I use the Selective Testing Variation prescribed in 178.601 (g) (2) to exclude testing of the inner\npackaging system as normally required in CFR 49 173.226 (c) (2) (iv)\nif the outer packaging complies with CFR 49 178 (g) (2) (i)-(vii)?\nI note that 178.601 (g) (2) indicates \"inner packagings of any type\" for solids or liquids, may be\nassembled and transported without testing in an outer packaging if the outer packaging complies with\nCFR 49 178 (g) (2) (i)-(vii).\nWe look forward your interpretation on the above question as we have received conflicting\ninformation from several sources regarding this\nquestion.\n1\n\n<<<PAGE 3>>>\n\nKind regards,\nJim McManus\nJim McManus\nProject Manager\nMobile 203-482-1606\nPhone 203-207-9307\n*************************\n***********\nindividual or entity named above.
