No. 11-0172\nDear Mr. Kerchner:\nThis responds to your July 18, 2011 request for clarification on the specifications for the Class 8\nCORROSIVE label under the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).\nSpecifically, you ask if the shaded hand on the CORROSIVE label provided in your enclosed\nphotograph complies with §§ 172.407 and 172.442 requirements.\nThe answer is no. The colors in the photograph you enclosed do not meet the label specification\nrequirements. The label illustration in§ 172.442 shows the outline ofthe hand in black with the\nhand in white on the white background in the top half of the label. \"White,\" as defined by the\nAmerican College Dictionary, is an \"achromatic color of maximum lightness; as new snow.\"\nThe variation in the white coloring in the top half of your example is not authorized.\nFurther, § 172.442(b) specifies that in addition to complying with the label specification\nrequirements found§ 172.407, the background of the CORROSIVE label must be white in the\ntop half and black in the lower half. Section 172.407 also requires that the symbol, text,\nnumbers, and border must be shown in black on a label except white must be used for the text\nand class number for the CORROSIVE label.\nI hope this answers your inquiry. Below is a photograph of the label in question.\nThere are no specifications in the labeling requirements of 49 CFR that address the\ncolor of the hand on the Corrosive label. We believe the shaded color above falls\nwithin the labeling specification found in 49 CFR § 172.407 for packages\ncontaining Class 8 corrosive hazardous materials and also meets the general\nlabeling requirements.
