Specifically, you ask if a 500-gallon\nbulk package containing diesel fuel residue, transported on public roads, in a commercial\nvehicle, for personal use is subject to the requirements of the HMR. You reference two\nletters of interpretation issued by PHMSA, one issued on April16, 2004 (Ref. No.: 03-0223)\nand the other issued on May 11, 2011 (Ref. No.: 11-0007).\nUnder Federal hazardous materials transportation law (Federal hazmat law), \"transports\" or\n\"transportation\" is defined as \"the movement of property and loading, unloading, or storage\nincidental to the movement.\" Federal hazmat law also defines \"commerce\" as \"trade or\ntransportation in the jurisdiction of the United States between a place in a State and a place\noutside of the State; that affects trade or transportation between a place in a State and a place\noutside of the State; or on a United States-registered aircraft.\" (See 49 U.S.C. 5102(1) and\n(13).) Historically, PHMSA also interprets \"in commerce\" to mean trade or transportation in\nfurtherance of a commercial enterprise. This interpretation is based in part on the Federal\nhazmat law's definition of \"person\" as including \"a government, Indian tribe, or authority of\na government or tribe that (i) offers hazardous material for transportation in commerce; (ii)\ntransports hazardous material to further a commercial enterprise; or (iii) designs,\nmanufactures, fabricates, inspects, marks, maintains, reconditions, repairs, or tests a\npackage, container, or packaging component that is represented, marked, certified, or sold as\nqualified for use in transporting hazardous materials in commerce .... \" See 49 U.S.C.\n5102(9); see also 49 CFR § 171.8.\nPHMSA has reviewed both letters and stands by the May 11, 2011 letter which states that\nnon-commercial transportation of hazardous materials is not subject to the HMR. In a final\nrule [Docket No. RSPA-98-4952 (HM-223)], titled \"Applicability of the Hazardous\n\n<<<PAGE 2>>>\n\nMaterials Regulations to Loading, Unloading, and Storage,\" which became effective on\nJune 1, 2005, we revised § 171.1 to clarify the applicability of the HMR to transportation\nfunctions. We believe that the inconsistency in the responses is a result of a better\nunderstanding of the meaning behind the term \"non-commercial\" transportation under the\nHMR.\nAs a general matter, the transportation of a hazardous material by motor vehicle for personal\nuse of the driver is not subject to requirements in the HMR - although it may be subject to\nother Federal, State, or local requirements. In fact, guidance issued by the Federal Motor\nCarrier Safety Administration regarding 49 CFR § 390.5 states that \"if the driver is\noperating a commercial motor vehicle at the direction of the motor carrier, it is considered\ninterstate commerce and is subject to the Federal Motor Carrier Safety Regulations\n(FMCSRs). If the motor carrier is allowing the driver to use the vehicle for private personal\ntransportation, such transportation is not subject to the FMCSRs.\" Your request for\ninterpretation did not contain enough information for PHMSA to confirm whether the driver\nwas transporting the 500-gallon bulk package containing diesel fuel residue for personal use,\nnor did it indicate that the motor carrier allowed the driver to use the vehicle for personal\ntransportation. When questioned by the\nInspector, the driver stated that tank came from the job site and he «took it upon himself to\nadd the see gallon tank to take home for personal use.\" The driver could not produce a bill\nof sale or a letter from his employer supporting his claim.\nA review of PHMSA Interpretation e3-e223 states that hazardous materials intended for\npersonal use, placed onto a commercial vehicle and transported on a public road, are subject\nto the HMR. As specified in§ 171.1, the HMR govern the transportation ofhazardous\nmaterials in intrastate, interstate and foreign commerce. Accordingly, hazardous materials that\nare transported by persons for personal use in their personal vehicles are not subject to the HMR.\nHowever, under the scenario descr~bed in your letter, although the gasoline was for personal use,\nit was placed onto a commercial v~hicle and transported on a public road. The transportation is,\ntherefore, \"in commerce,\" and the gasoliiJ.:e.is subject to the requirements of the HMR.\nYou also asked whether the materi~s oftl.'i!de exception (MOT) applies to this scenario. The\nanswer is yes, the MOT exception fq>plies to the scenario you described, provided all applicable\nprovisions in§§ 171.8 and 173.61;U'e met. Based thereon, it was concluded that \"the individual who\ntransports his/her own scuba tank for personal, non commercial use (e.g., recreation, sport fishing)\nis not subject to the HMR.\"\nThe questions being presented include the following:\n1. Is the individual owner/driver having the described battery-operated Personal Items in the leased\nequipment while the owner/driver is operating the leased equipment in the furtherance of the\ncommercial enterprise of the motor carrier subject to the Hazardous Materials Regulations?\n2. In these circumstances, is the motor carrier subject to the Hazardous Materials Regulations?\nAs noted, the Personal Items of the owner/drivers also include empty fuel tanks having a capacity\nof five (5) to thirty (30) gallons that the owner/drivers use to fuel off-road equipment, boats, and\nother non-commercial motor vehicles of the owner/driver. Generally, the equipment, boats and\nother non-commercial vehicles are gasoline powered. As with the personal battery-operated items,\nthe leased equipment is being utilized to transport other property in furtherance of the commercial\nenterprise of the motor carrier and the fuel tanks are not required by the motor carrier for such\ntransportation.\n3. Noting that 49 CFR Part 390.3 excepts from the applicability of the rules in subchapter B the\noccasional transportation of personal property by individuals not for compensation nor in the\nfurtherance of a commercial enterprise also except the applicability of the Hazardous Materials\nRegulations for the occasional transportation of the described personal property of the\nowner/drivers herein?\n4. Are the described fuel tanks utilized for gasoline either empty or full considered materials of\ntrade as noted in 49 CFR Part 392.51 and as defmed in 49 CFR Part 171.8?\n5.
