Blue Ridge Blvd.,\nKansas City, MO 64146\nRef. No. 12-0045\nDear Mr. Barrett:\nThis responds to your February 1, 2012 letter regarding overpack requirements under the\nHazardous Materials Regulations (HMR; 49 CFR Parts 171-180). According to your\nletter, the following Division 1.4S and Division 4.1 products, respectively, are prepared\nand packaged in single or combination packagings in accordance with the HMR: ( 1)\n\"Cartridges, small arms, UN0012,\" \"Cartridges, small arms, blank, UN0014,\" \"Cases,\ncartridge, empty with primer, UN0055,\" and \"Primers, cap type, UN0044;\" and (2) \"Black\npowder for small arms, NA0027\" and \"Smokeless powder for small arms, NA3178.\"\nSpecifically, you ask whether, for motor vehicle transport, these materials along with non-\nhazardous material may be consolidated in an overpack. Additionally, you request\nconfirmation that the quantity limit for the black powder and smokeless powder is 1 00\npounds net mass each and not a combined amount.\nWith regard to your first request, the answer is yes, provided the mixed packaging\nrequirements of§ 173.61(a) are met. Section 173.61(a) prohibits the packing of an\nexplosive with a material that could adversely impact the explosive or its packaging under\nnormal transportation conditions. Otherwise, there are no further restrictions under the\ngeneral transportation requirements of the HMR. With regard to your second request, your\nunderstanding of the limits on transporting black powder and smokeless powder is correct.\nThe total quantity authorized in one motor vehicle, for example, is 1 00 pounds net mass\neach and not a combined amount. See § § 173.170 and 173.171.\nI hope this information is helpful. If you have further questions, please contact this office.\nsj;t~\nBen Supko\nActing Chief, Standards Development Branch\nStandards and Rulemaking Division\n\n<<<PAGE 2>>>\n\nl)er k;ndeY'eY1\n~llZ.tO/\n~113·~\nAp pJ,Ca_fo,'fi+:J\nIZ -00 ~5\nFebruary 1, 2012\nStandards and Rulemaking Division\nPipeline and Hazardous Materials Safety Administration\nAttn: PHH-1 0\nU.S. Department of Transportation\nEast Building, 1200 New Jersey Avenue, SE.\nWashington, DC 20590-0001\nRe: Interpretation\nTo Whom It May Concern:\nWe request an interpretation concerning the following products:\nNA0027, Black powder for small arms, 4.1, I\nNA3178, Smokeless powder for small arms, 4.1, I\nUN 0012, Cartridges, small arms, 1.4S, II\nUN 0014, Cartridges, small arms, blank, 1.4S, II\nUN 0044, Primers, cap type, 1.4S, II\nUN 0055, Cases, cartridge, empty with primer, 1.4S, II\nNon-hazardous materials\nAfter packing in a single or combination package according to the Hazardous Materials Regulations,\nmay these packages then be legally overpacked together?
