No. 12-0066\nDear Mr. Bailey:\nThis responds to your February 17, 2012 request for clarification of the Hazardous Materials\nRegulations (HMR; 49 CFR Parts 171-180). Specifically, you request confirmation that\nyour drivers are not required to have a hazardous materials (HM) endorsement to their\ncommercial driver's licenses (CDLs) in order to transport your slag material,\n\"Environmentally hazardous substance, solid, n.o.s., (contains lead), Class 9, UN 3077,\nPG Ill, RQ 10.\"\nIn accordance with § 172.504(1)(9), placarding is not required for transportation of Class 9\nmaterial when shipped domestically. However, a bulk packaging must be marked with the\nappropriate identification number, and the number may be display on either a Class 9\nplacard, an orange panel, or a white square-on-point configuration. While the HMR allow\ndisplay of the identification number on a Class 9 placard, use of this configuration does not\nmake your drivers subject to the endorsement requirement under 49 CFR 383.93 of the\nFederal Motor Carrier Safety Regulations (FMCSR).\nFor purposes of the COL HM endorsement, the term \"Hazardous Materials\" is defined in 49\nCFR § 383.5 as a material that has been designated as hazardous under 49 U .S.C. 5103 and\nis required to be placarded under subpart F of 49 CPR part 172 or any quantity of a material\nlisted as a select agent or toxin in 42 CPR part 73. Therefore, pursuant to the FMCSR, a\ndriver of a commercial motor vehicle transporting a Class 9 hazardous material that is\nexcepted from placarding for domestic transportation, is not required to obtain a hazardous\nmaterials endorsement to his or her COL.\nI hope this answers your inquiry. If you need additional assistance, please contact this office\nat 202-366-8553.\nSincerely,\nRobert Benedict\nChief, Standards Development Branch\nStandards and Rulemaking Division\n\n<<<PAGE 2>>>\n\n703 Hennis Road Winter Garden, FL 34787 * P- 407-877-2600 * F- 407-877-7064\nFebruary 17, 2012\nMr. Charles E. Betts\nOffice of Hazardous Materials Standards\nU.S. DOT I PHMSA (PHH-10)\n1200 New Jersey Ave., SE East Building 2\"d Floor\nWashington, DC 20590\nDear Mr. Betts:\nI would like to respectfully request an interpretation regarding a shipment of slag.\nProper shipping name: Feedstock for lead recycling operation.\nPer the attached shippers order, this product is slag that contains lead. Environmentally\nhazardous substance, solid N.O.S (contains lead), class 9, UN3077, PGIII, RQ10.\nMy understanding of the hazmat laws and CDL endorsement regulations is:\n1. Per 49CFR 172.504 (9) this class 9 product only needs to be labeled, not\nplacarded.\n2. 3. Our CDL drivers can transport it without a hazmat endorsement on their license.\nIf the customer chooses to put class 9, UN3077 placards on the trailer instead of\nusing ID stick on labels on the trailer to ID the bulk product inside, does the fact\nthat the trailer is ID with class 9 placards now make our drivers subject to needing\na hazmat endorsement? Or is it correct to say that the class 9 UN3077 placards are\nexempt from needing the hazmat endorsement?\nWe want to transport this product in a tarp covered dump trailer. The product is dry and\nships in an inert state at room temperature.\nWould you please let us know if our interpretation of the laws are correct? I believe the\nproduct we want to transport would be covered by your response letter to Reynolds\nTransport and your answer to them would apply to us also.\nRespectfully,\nff--14~\nJeff Bailey, Safety Director\n\n<<<PAGE 3>>>\n\nThis Shipping Order must oe legtbty filled tn, tn Ink mdellble t-'encu, or tn\nCarbon, and retained by the agent Shipper No. .nst . ..-21/~\nSk'2-\ncarrier No. __ v.;:;.. _____ _\nPage._!_ of .3_\n(Name of carrier) (SCAC) 2-l-!2_ Date--------\nOr.: Collect on Delivery shipments, the letlers\"CCD\" must appaar before consignee's name or as otherwiSe provided In Item 430, Sec.1.\nTO: Q ..., t...-o '\"\"V, \"\" ,,..,c -\nFROM: L_ n -\n-~- . 0 ,-v::: s·\nShipper ~NV ( tLO \\-QC-l.A . .:S 1 EGit--J, l !,..,.Qic\nConsignee ::;)~ ~t.JyU!<.: .I;;:\nStreet wsos-..JEV\\.Jp L ;A-v.z-\nZip Code 33(o ~~\nCity£ PG-1\\ 1\\)\nState fv1!V Zip Code 55 i 1.. \\ 2<$hr.: Emergency Contact Tel.
