You state that you ship 24 one-pound pouches of Calcium\nHypochlorite as a consumer commodity. You ask whether the amount of Calcium\nHypochlorite in each individual pouch or the amount contained in the entire outer\npackaging is to be used in determining whether a RQ is met.\nAs prescribed in§ 171.8, a hazardous substance is defined as a substance listed in\nAppendix A of§ 172.101 and in a quantity, in one package, which equals or exceeds the\nRQ listed in Appendix A to§ 172.101. A package or outside package is also defined as a\npackaging plus its contents. Further, a combination package is defined as one or more\ninner packagings secured in a non-bulk outer packaging. Based on the information,\npictures, and supporting information provided in your letter, it is the opinion of this Office\nthat the pouches of Calcium Hypochlorite are inner packagings of a combination package\nthus making the entire package subject to the RQ for Calcium Hypochlorite.\nI hope this satisfies your inquiry. Please contact us if we can be of further assistance.\nSincerely,\nT. The outer package contains 24- 1 pound pouches of Calcium\nHypochlorite for swimming pool treatment. The pouches are in a strong outer package as required. The total weight is\n1 pound of Calcium Hypochlorite per pouch or 24 pounds of Calcium Hypochlorite per strong outer package. The RQ for\nCalcium Hypochlorite is 10 pounds. The definition for hazardous substance states two conditions must be met 1) Is\nlisted in the Appendix A to 172.101 of this subchapter and 2) Is in a quantity, in one package, which equals or exceeds\nthe RQ listed in appendix A.\nIn determining what is meant by 11 in one package\" I have reviewed the definition of package which also reference outer\npackage and packaging. I am unsure what is meant by the phrase in one package. Is it referencing the individual!\npound pouches which do not meet the RQ or is it referencing the strong outer package which would meet the RQ?\nPhotos of the pouches and strong outer package are attached.\nThank you for your assistance on this matter.\nTom Forbes\nPublic Utilities Commission of Ohio\nTransportation Department\nHazardous Materails Specialist\n{614) 644-0296\nPUCO.ohio.gov\n(j(J\nThis message and any response to it may constitute a public record and thus may be publicly available to anyone\nwho requests it.\n1\n\n<<<PAGE 3>>>\n\nCONSUMER COMMODITY\nFOR CHEMICAL EMERGENCY, SPILL, LEAK,\nFIRE, EXPOSURE, OR ACCIDENT CALL:\nORM-D\nCHEMTREC 1-800-424-9300\nRQ (CALCIUM HYPOCHLORITE)\n71428\nGLB SUPER CHARGE 24X1LB\n1 07 85336 71428 5\nCONSUMER COMMODITY\nORM-D\nFIRE EXPOSURE OR ARM\nPORCHES FURORNOY SPILL LEAK\n\n<<<PAGE 4>>>\n\nH\nK\nGLB\nSuper Charge\nSUPER CHLORINATION FOR POOLS - KILLS\nBACTERIA, DESTROYS ORGANIC WASTE\nAND CONTROLS ALGAE\nNET WT 1LB-454G\nSold by weight, not volume\nACTIVE INGREDIENT:\nINERT INGREDIENTS:\nCalcium Hypochlorite\n.35%\n.65%\nand First A\nDANGER: See other precautions\non the back panel.\nEEP OU\nEACH OF\nJILDREN","truncated":false,"body_characters":4365}
