No.: 13-0008\nDear Mr. Moothart:\nThis is in response to your January 7, 2013 email requesting clarification of the Hazardous\nMaterials Regulations (HMR; 49 CFR Parts 171-180). Specifically, you seek clarification\nof the packaging requirements for non-bulk shipments in specification packaging of\nmaterials regulated as a hazardous waste. You indicate that you will be using the packaging\nexception provided in § 173 .12( c), which allows previously used packagings to be reused for\nshipments of waste materials transported for disposal or recovery. Your questions are\nparaphrased and answered below.\nQ 1. Must non-bulk specification packagings, (i.e., 55-gallon drums) meet the\nrequirements of Part 178 when using the exception provided in § 173 .12( c)?\nA 1. Yes. Non-bulk specification packagings that are being reused to ship hazardous\nwaste under the exception provided in § 173 .12( c) are subject to all applicable\nrequirements in Part 178, except those pertaining to the reconditioning and reuse\nproVISIOnS.\nQ2. Are there any hazard classes that would not be allowed under the exception in\n§ 173.12 for hazardous waste?\nA2. No. A waste material in any hazard class may be transported for disposal or\nrecovery under the exceptions provided in § 173.12.\nQ3. Is it a correct understanding that § 173 .28(b )( 6) provides relief from the\ncontainer reconditioning requirement for waste materials identified in\n§ 173.12(c)(5)?\n\n<<<PAGE 2>>>\n\nA3. Yes. As provided by § 173 .28(b )( 6) a \"previously used non-bulk packaging\nmay be reused for the shipment of hazardous waste, not subject to the reconditioning\nand reuse provisions of this section, in accordance with§ 173.12(c).\"\nI hope this information is helpful.
