Specifically, you ask if a 330\ngallon portable tank without a current certification date for pressure testing under\n§ 180.605(k) can be used to ship a non-hazardous material?\nThe answer is no. Under § 171.2(g), no person may represent or offer a packaging as\nmeeting the requirements of the HMR unless the packaging is maintained, marked, and\nretested in accordance with the applicable requirements of the HMR when transported in\ncommerce. These requirements are applicable whether or not the packaging is used for the\ntransportation of a hazardous material. Therefore, if the UN standard or DOT specification\npackaging used at your facility is not maintained in accordance with the HMR, we\nrecommend you securely cover any identifying marks or specification plates representing it\nas such.\nI hope this satisfies your request.\nSincerely,\nAenFaster\nT. (1)\nEach IM or UN portable tank must be\nEnglish, with the date (month and\ndurably and legibly marked, in\nyear) of the last pressure test, the identification\nagency witnessing the test, when required,\nmarkings of the approval\ninspection. The marking must be\nand the date of the last visual\nplate, in letters and numerals of\nplaced on or near the metal identification\nwhen on the metal identification plate,\nnot less than 3mm (0.118 inches) high\nthe portable tank.\nand 12 mm (0.47 inches) high when on\nWe do not haul any product of a hazardous nature in these vessels.
