Specifically, you provide a sample bill\noflading (BOL) for a crude oil rail shipment and outline the roles of several parties involved\nin the shipment.\nYou state in your email that Company A owns the crude oil and railcars. Company C owns\nthe crude oil loading unit train terminal in Wyoming. Company C has a contractor,\nContractor 1, who provides moving and loading services at the loading terminal. Contractor 1\narranges for Company A's crude to be loaded into Company A's railcars and prepares the\nrailcars for shipment, including preparing shipping papers. Contractor 1 signs the\ncertification indicating everything was done in accordance with the regulations. You ask if\nthe Pipeline and Hazardous Materials Safety Administration (PHMSA) takes exception with\nlisting Company A as the shipper on the BOL.\nThe answer is no. Company A may be listed as the shipper on the BOL. Under the HMR,\nany person performing functions of an offeror, as defined in§ 171.8, must take responsibili.ty\nfor performing those functions in accordance with the applicable requirements. Based on your\ndescription, Contractor 1, at the direction of or through contractual arrangement with\nCompany C, performs offeror (shipper) functions, such as preparing the railcars for shipment\n\n<<<PAGE 2>>>\n\n2\nand signing the certification. Listing Company A as the shipper on the BOL does not\nnecessarily relieve Contractor 1 or Company C of its offeror responsibilities. COMPANY Chas a contractor, CONTRACTOR 1, who\nprovides the train moving and railcar loading services at the loading terminal. In the case of this sample BOL, we are\nworking with COMPANY A on this particular train.\nCOMPANY C arranges for COMPANY A's oil to be transported into one of the rail facility's loading tanks via\npipeline (no trucks involved).\nCOMPANY A owns the oil throughout the entire scenario.\nCOMPANY Chas a lab(s) that carries out our quality testing and classification program and that information is\nshared with CONTRACTOR 1.\nCOMPANY A schedules their railcars with BNSF Railway to arrive at the facility to be filled with their crude oil.\nOnce the train arrives, CONTRACTOR 1 arranges for COMPANY A's crude to be moved from the loading tank to\nthe loading rack and into COMPANY A's railcars.\nCONTRACTOR 1 secures the railcars and gets it ready for shipment.\nCONTRACTOR 1 prepares the shipping papers.\nCOMPANY A has provided the emergency response numbers to COMPANY C and COMPANY Chas passed that to\nCONTRACTOR 1 in order to put on shipping paper.\nCONTRACTOR 1 and COMPANY A review the shipping paper to verify compliance.\nCONTRACTOR 1 manager (Anthony Fike) signs the certification indicating everything was done according to\nregulations.\nAs you can see on the BOL, COMPANY A is listed as the Shipper/Consignee, Care Of Party is COMPANY B (destination),\nThird Party payer of freight is COMPANY C, shipped from the Account Of CONTRACTOR 1, and Ship From COMPANY C.\nBased on the above information, does PHMSA take any exception to the BOL and specifically any exception to who is\nlisted as the Shipper?
