Specifically, you request confirmation that the\nrequirements adopted in this final rule do not apply to materials with a subsidiary hazard of\nClass 3 flammable liquid.\nYour understanding is correct. On May 8, 2015, the Pipeline and Hazardous Materials Safety\nAdministration, in coordination with the Federal Railroad Administration, issued a final rule,\nentitled \"Hazardous Materials: Enhanced Tank Car Standards and Operational Controls for\nHigh-Hazard Flammable Trains.\" In the rule, PHMSA adopted enhanced tank car standards\nand operational controls for high-hazard flammable trains. As used in the final rule, Class 3\nrefers to the primary hazard or hazard class of the material as indicated in Column (3) of the\nHazardous Materials Table in 49 CFR 172.101.\nI trust this satisfies your inquiry.
