Wagner\nAmeriGas Propane\n460 N. Gulph Rd.\nKing of Prussia, PA 19406\nRef. No. 15-0242\nDear Mr. Wagner:\nThis is a response to your December 9, 2015 email requesting a letter of interpretation of the\nHazardous Materials Regulations (HMR; 49 CFR Parts 171-180) regarding specification MC\n331 reflective design in accordance with § 178.337-1(d). You provide a photograph of a\nMC331 reflective design incorporating both white and aluminum colors and a supporting\nreflective scale for the colors used. It is your understanding based on the information\nprovided that your tank meets the reflective design requirements of the HMR.\nYour understanding is correct. It is the opinion of this Office that since the majority of the\ncolor on the upper two thirds of the cargo tank is white or aluminum and that there is a limited\namount of the red and blue color in the American Flag and the AmeriGas logo, that the paint\nscheme on the cargo tank would be in compliance with § 178.337-1(d).\nI hope this answers your inquiry. If you need additional assistance, please contact this Office\nagain.\nSincerely,\nSirk Der Kindere\nChief, Standards Development Branch\nStandards and Rulemaking Division\n\n<<<PAGE 2>>>\n\n:\nMitchell\n$178.337-1(d\nCargo Tanks\nDodd, Alice (PHMSA)\n15-0246\nFrom:\nGeller, Shelby CTR (PHMSA)\nSent:\nWednesday, December 09, 2015 3:27 PM\nTo:\nHazmat Interps\nSubject:\nFW: Request for Interpretation\nDear Shante and Alice,\nBelow is a request for a formal letter of interpretation. [mailto:Christopher.Wagner@amerigas.com]\nSent: Wednesday, December 09, 2015 1:20 PM\nTo: PHMSA HM InfoCenter\nSubject: Request for Interpretation\nGood afternoon,\nI am writing to request an interpretation of the intent of 49 CFR 178.337-1 (d) as it relates to the reflective nature.of the\nupper two-thirds of a cargo tank barrel on MC-331 specification tanks permanently attached to a cargo tank motor\n. vehicle.\nThe regulation states that every uninsulated cargo tank permanently attached to a cargo tank motor vehicle shall, unless\ncovered with a jacket made of aluminum, stainless steel, or other bright non-tarnishing metal, be painted a white,\naluminum or similar reflecting color on the upper two-thirds of area of the cargo tank. In a recent campaign to support our\nbelow:\ntroops we have designed a wrap for our cargo tanks consisting primarily of both white and aluminum colors as pictured\n-Amertuass\nIt is our interpretation based on the below reflective scale that our tank barrel does in fact meet a reflective standard\nconsistent with the white or aluminum requirement.\n1\n\n<<<PAGE 3>>>\n\nLRV Scale (not the same as grayscale) ELSAmArA\n0%\n10%\n20%\n30%\n40%\n50%\n60%\n70%\n80%\n90%\n100%\nWe also believe that based on previous interpretations in this regulation that the red and blue in the American Flag and\nthe AmeriGas logo are in limited quantity and would not impact the majority color on the upper two-thirds of the cargo\ntank which is white and silver. (Reference 14-0180, 11-0067, 02-0163)\nThank you in advance for your guidance and assistance.\nBe Safe!\nSafety Compliance and Training Director\nChristopher J. Wagner\n460 N.
