Brown\nFHP-CVE West Palm Beach Office\nLake Worth Service Plaza, Bldg 9320\nMilepost 94, Florida Turnpike\nLake Worth, FL 33467\n· Reference No. 18-0025\nDear Sergeant Brown:\nThis letter is in response to your February 19, 2018, email requesting clarification of the\nHazardous Materials Regulations (HMR; 49 CFR Parts 171-180) applicable to exceptions for\n\"UN1073, Oxygen, refrigerated liquid (cryogenic liquid)\" under§ 173.320.\nWe have paraphrased and answered your questions as follows:\nQ 1. You ask whether the labeling and placarding requirements in Subparts E and F of\nPart 172 apply to \"UN1073, Oxygen, refrigerated liquid\" with respect to § l 73.320(a)(2).\nA 1. The answer is yes. All subparts of Part 172, including Subparts E and F, are applicable\nwhen shipping cryogenic liquids (i.e., refrigerated liquid oxygen) in accordance with\n§ 173.320.\nQ2. You ask whether non-specification cylinders, cargo tanks, and portable tanks are\nauthorized for refrigerated liquid oxygen when shipping in accordance with the\nexceptions for cryogenic liquids in§ l 73.320(a).\n\n<<<PAGE 2>>>\n\nA2. The answer is yes, provided the requirements of§ 173.320(a) are met. To use the\nexceptions provided in§ 173.320, cryogenic liquids-such as UN1073-must be\ntransported in Dewar flasks, insulated cylinders, insulated portable tanks, insulated cargo\ntanks, or insulated tank cars that are designed and constructed so that the pressure will not\nexceed 25.3 psig under ambient conditions. Note that shipping under this exception is\nrestricted to transportation by rail and highway.\nI hope this information is helpful. Please contact us if we can be of further assistance.\nChief, Standards Development Branch\nStandards and Rulemaking Division\n\n<<<PAGE 3>>>\n\nDodd, Alice (PHMSA)\nFrom: INFOCNTR (PHMSA)\nSent:\nTo:\nWednesday, February 21, 2018 2:21 PM\nHazmat Interps\nSubject: FW: Request for Interpretation\nHello all,\nPlease see the below LOI request.\nRegards,\n-Breanna\nFrom: Brown, Steve [mailto:SteveBrown@flhsmv.gov]\nSent: Monday, February 19, 2018 1:15 PM\nTo: PHMSA HM lnfoCenter <PHMSAHMlnfoCenter@dot.gov>\nSubject: Request for Interpretation\nTo whom it may concern,\nPlease see the following questions to which a formal interpretation is being requested.\n173.320 (a){l), (2) & (3) provide exceptions when transporting cryogenic liquids. In particular, the carrier or shipper\nmust comply with 173.320 (2) Subparts A, B, C, D, G and Hof part 172, (§§174.24 for rail and 177.817 for highway) and\nin addition, part 172 in its entirety for oxygen. Subparts E (labeling) and F (placarding) of Part 172 are not listed and\ntherefore can be interpreted as not being required.\n1. 2. 3. 4. Does \"Part 172 in its entirety for oxygen\" mean that because the shippers/carriers are offering or transporting\nUN1073 (oxygen), they are now subject to Subparts E and F of Part 172?\nIf not subject to Part 172 in its entirety, what placards, if any, are required for a vehicle transporting UN1073\nOxygen, refrigerated liquid (cryogenic liquid) in bulk packages?\nIf not subject to Part 172 in its entirety, are the 2.2 andS.1 labels required to be displayed on non-bulk packages\nof UN1073 Oxygen, refrigerated liquid (cryogenic liquid)?\nAre non-spec cylinders, cargo tanks and portable tanks authorized?\nSergeant Steve L.
