Specifically, you ask whether a material that does not meet the\ndefinition of \"radioactive material\" in § 173.403 may be transported as a non-hazardous material.\nIn accordance with § 173.22 of the HMR, it is the shipper's responsibility to properly classify a\nhazardous material. This Office generally does not perform this function. Section 173.403\ndefines \"radioactive material\" as any material containing radionuclides where both the activity\nconcentration and the total activity in the consignment exceed the values specified in the table in\n§ 173.436 or values derived according to instructions in § 173.433. If a material does not meet\nthis definition, then it is not considered radioactive material under the HMR.\nFurthermore, if the material does not meet the definition of any other hazard class or division, it\nis not considered a hazardous material subject to the HMR and may be transported as a\nnon-hazardous material.\nI hope this information is helpful.
