You note that § 1 71.23 (b )(7) lists requirements for specific materials transported under\nthe International Maritime Dangerous Goods (IMDG) Code. You add that§ 171.23(b)(7)\nrequires that, except for marine pollutants transported in accordance with the IMDG\nCode, marine pollutants transported in bulk packages must meet the shipping paper\nrequirements in § 172.203(1) and the marking requirements in § 172.322. You ask the\nrationale for this section referring only to bulk packages and not non-bulk packages.\nAl. The provisions of§ 171.23(b)(7) are intended to address marine pollutants transported in\naccordance with standards other than the IMDG Code authorized in Subpart C of Part\n171. Therefore, a bulk package containing a marine pollutant transported in accordance\nwith a standard other than the IMDG Code is subject to the requirements of§ 172.203(1)\nand§ 172.322. For example, a bulk package containing a marine pollutant transported in\naccordance with the International Civil Aviation Code (ICAO) Technical Instructions\n(TI) must to be marked with the MARINE POLLUTANT mark on at least two opposing\nsides even though is not a requirement of the ICAO TI. In addition, the provisions of\n§ 171.23(b)(7) only contemplate bulk packages as non-bulk packages are not subject to\nthe above requirements when transported by modes other than vessel. When all or part of\ntransportation is by vessel, the non-bulk packages would be required to be transported in\naccordance with the IMDG Code or HMR.\n\n<<<PAGE 2>>>\n\nQ2. A2. You ask if \"transported in accordance with the IMDG Code\" means that a material\nshipped to the United States as \"not regulated\" due to it not being a marine pollutant\nunder Section 2.9.3.4 of the IMDG Code is not subject to the HMR when transported\nunder the IMDG Code.\nA material or solution that meets the definition of a marine pollutant in§ 171.8 of the\nHMR but does not meet the criteria for a marine pollutant as provided in Sections 2.9.3.3\nand 2.9.3.4 of the IMDG Code may be excepted from the requirements of the HMR as a\nmarine pollutant if that exception is approved by the Pipeline and Hazardous Materials\nSafety Administration's Associate Administrator for Hazardous Materials Safety (see\n§ 172.101, appendix B, paragraph 5).\nSincerely,\n~~~\nT. Specifically,\nl 71.23(b)(7) requires that except for marine pollutants\ntransported in accordance with the IMDG Code, marine\npollutants transported in bulk packages must meet the\nshipping paper requirements in § l 72.203(1) and the package\nmarking requirements in §172.322. This does not include\nmarine pollutants in non-bulk packages. What is the reason\nand benefit for only referring to bulk packages and not non-\nbulk? Does this mean that marine pollutants that are not\ntransported in accordance with the IMDG Code are not\nsubject to l 72.203(1) and l 72.322?\nAn example would be if a material was shipped to the U.S. as\n\"not regulated\" due to it not being a marine pollutant acc. to\n2.9.3.4 IMDG Code, however, being a marine pollutant\naccording to App. B to § l 72. l 01, when shipped to the U.S.\nPage l of 2\n\n<<<PAGE 5>>>\n\nin non-bulk packages, l 71 .23(b)(7) infers this would be \"not\nregulated\" by sea and US land transportation as well because\nonly bulk is mentioned and required to follow l 72.203(1) and\nl 72.322.\nAdditionally, is it possible that the underlined clause\n\"transported in accordance with the IMDG Code\" means that\na material shipped to the U.S. as \"not regulated\" due to it not\nbeing a marine pollutant acc. to 2.9.3.4 IMDG Code is not\nsubject to the CFR 49, as well, because it is transported in\naccordance with the IMDG Code, i.e. not regulated based on\nthe provision and criteria of the IMDG Code?\nTherefore, we ask for further explanation on this issue.\nAny guidance and interpretation would be greatly\nappreciated.\nThank you for your time and guidance.\nSincerely yours,\ntirltl/\nRobert Miller\nManager - Transportation Safety\nProduct Regulatory Services\nUSA\nPage 2 of 2","truncated":false,"body_characters":7006}
