In your email, you state the Hunter Fan company provides residential ceiling fans with\na remote control and one lithium button cell battery (not installed in the remote control) in the\nsame packaging. The packages are stacked together on a single pallet, and you ask questions\nregarding the marking and labeling requirements for these packages.\nWe have paraphrased and answered your questions as follows:\nQI. Regarding§ 173.185(c)(3)(i), you ask whether the lithium battery mark must be affixed\nto a particular side of the package.\nAl. The answer is no. Bear in mind lithium button cell batteries are not subject to the lithium\nbattery marking when installed in equipment (i.e., installed in the remote control).\nQ2. You ask if§ 173.185(c)(3)(i) does not specify a particular side for the placement of the\nlithium battery marking, would§ 172.406(a)(l)(i) be applicable to the packages.\nA2. The answer is no.\nQ3. You ask whether the location of the mark on the package shown in the photograph you\nprovided is acceptable.\n\n<<<PAGE 2>>>\n\nA3. The a,nswer is yes. Although you are not subject to the hazard communication\nrequirements of part 172 of the HMR, you are subject to the overpack requirements with\nregard to palletizing the packages in§ 173.25(a).\nI hope this information is helpful. The regulation\ndoes not indicate left, right, front, back, top, or bottom. Please confirm whether the regulation requires the label be\naffixed to a particular side.\nQuestion 2:\nIf 49 CFR 173.18S(c)(3)(i) doesn't specify a particular side of the ceiling fan packaging, is 49 172.406(a)(l)(i) applicable to\nthis Hunter product? That section indicates the bottom cannot contain a label. It is unclear to Hunter whether 49\n172.406(a)(l)(i) is applicable.\nQuestion 3:\nI attached an image of the proposed packaging for the Hunter Leander ceiling fan model. The location of the lithium\nbattery mark is shown on a side panel of the packaging. Is this location acceptable? The ceiling fan packaging already\ncontains others requirements (e.g. FTC label) in addition to basic product information that is needed to aid potential\nconsumers when reviewing the Hunter product on a store shelf in a big box store.
