In this instance, the answer is no. In DOT-SP 16171, the pallet (containing the batteries\nand the totes of other non-hazardous materials) is the package which must be described\non the shipping paper. It is prepared for transportation\nin accordance with 49 CFR 173.159 (c) (1) and \"firmly secured to skids or pallets\" as\noutlined in this part, as non specification packaging authorized for batteries packed\nwithout other materials.\n49 CFR 172.202 (a) (7) requires the bill of lading to indicate the number and ~ of\npackages \"(for example, \"12 Drums\")\" for a regulated hazardous material entry on a bill\nof lading. It is my understanding from previous conversations with the Department of\nTransportation, that a \"pallet or skid\" can not \"contain\" (as a means of restraint) a liquid,\nsolid or gas and therefore is not by definition a \"packaging\" but an instrument of\nconveyance. I understand and do not disagree with that explanation. My concern is the\nappropriate way to describe this battery on a bill of lading in compliance with 172.202 (a)\n(7) when packaged in accordance with 173.159 (c) (1). Would the description: 1 skid,\nBattery wet filled with acid, 8, UN2794, III 650 pounds, be in compliance with this\nsection? Does PHMSA accept \"Battery\" as being a valid description of packaging in the\ncase where there is no external packaging around the battery case? SAFETY CONTROL MEASURES: PACKAGING - Prescribed packagings\nare non-specification packagings as described:\n(1) Alternative 1: Gaylord pallet, (a plastic pallet\nwith solid walls) as described in the application, dated\nMay 19, 2014, containing the batteries in no more than\ntwo layers provided the top layer allows space between\nthe terminals and the top cover of the pallet. The\npallet may be split into two compartments using a\nplastic divider. The compartment not containing\nbatteries may include compatible hazardous material s.\nVoid space in the compartment containing batteries may\nbe filled with non-hazardous materials. All void spaces\nwithin in the pallet must be filled with non-hazardous,\nnon-conducting bracing or cushioning materials to\nprevent shifting of the batteries during transportation.\nAddit i onal Gaylord pallets or wood pallets may be\nstacked on top of the Gaylord pallets and the completed\nload must be securely shrink- or stretch-wrapped\ntogether.\n(2) Alternative 2: Batteries are placed on a wooden\npallet and shrink- or stretch-wrapped to secure the\nbatteries from movement. When batteries do not fill up\nthe entire pallet area, the remainder of the area may be\nfilled with one or more layers of plastic totes. The\ntotes may contain conductive, non-hazardous, or\ncompatible hazardous materials. Pallets with complete\nlayers of batteries may have plastic totes or fiberboard\nboxes containing conductive, non-hazardous , or\ncompatible hazardous materials placed on top. The pallet\nheight must not exceed one and a half times the width of\nthe pallet. All contents of a completed pallet must be\nsecured with shrink- or stretch-wrap.\n\n<<<PAGE 9>>>\n\nContinuation of DOT-SP 16171 (1 st Rev.) Page 3\nSeptember 26, 2014\n(3) Gaylord and wooden pallets must be capable of\nwithstanding, without damage, a superimposed weight\nequal to two times the weight of the unit or, if the\nunit exceeds 907 kg (2,000 pounds), a superimposed\nweight of 184 kg (4,000 pounds).\n(4) Batteries that are placed on the wooden pallets\nmust cover the bottom layer to the maximum extent\npossible prior to creating additional layers.\n(5) Battery terminals must be protected in accordance\nwith§ 173.159(a) (2). Battery terminals must not be\nrelied upon to support any part of the superimposed\nweight and must not short out if a conductive material\nis placed in direct contact with them.\n(6) The top of each layer of batteries must be\nprotected by strong corrugated fiberboard or rigid\nplastic if additional batteries or materials are placed\nupon them.\n(7) Plastic totes or fiberboard boxes containing\nhazardous materials other than batteries must be\npackaged in accordance with the HMR.\n(8) Non-hazardous conductive materials must be\ncontained in strong outer packagings that are sift-proof\nif solid or leakproof if liquid.\n(9) Each completed wood or Gaylord pallet must be\nmarked and labeled in accordance with the HMR.\n8. SPECIAL PROVISIONS:\na. A person who is not a holder of this special permit who\nreceives a package covered by this special permit may\nreoffer it for transportation provided no modification or\nchange is made to the package and it is reoffered for\ntransportation in conformance with this special permit and\nthe HMR.\nb. A current copy of this special permit must be maintained\nat each facility where the package is offered or reoffered\nfor transportation.\n9.
