Box 1440\nHightstown, NJ 08520\nReference No. 19-0081\nDear Mr. Herman:\nThis letter is in response to your June 12, 2019, email requesting clarification of the Hazardous\nMaterials Regulations (HMR; 49 CFR Parts 171-180) applicable to a shipper's certification on a\nshipping paper.\nIn the scenario you describe, a shipment was made in a cargo tank supplied by the carrier and, in\naccordance with§ 172.204(b)(l)(i), a shipper's certification was not required. However, a\ncertification statement was provided on the shipping paper and contained a misspelling;\nspecifically, \"accurately\" was spelled \"accuratly\" in the certification statement.\nWe have paraphrased and answered your questions as follows:\nQ 1. You ask whether a shipper's certification that appears on a shipping paper when the\ncertification is not required must otherwise conform to § 172.204.\nA 1. The answer is no. If a shipper's certification is not required due to an exception provided\nby§ 172.204(b), the requirements for the certification statement in§ 172.204(a) do not\napply.\nQ2. You ask, if the answer to question Q 1 is yes, whether the misspelling of the word\n\"accurately\" constitutes a bona fide modification to the language prescribed in\n§ 172.204(a)(2).\nA2. See Al.\nI hope this information is helpful. Please contact us if we can be of further assistance.\n\n<<<PAGE 2>>>\n\nDodd, Alice (PHMSA)\nFrom: INFOCNTR (PHMSA)\nSent:\nTo:\nAttachments: Tuesday, June 18, 2019 3:27 PM\nHazmat Interps\nSubject: FW: Request for Guidance/Interpretation\nRequest for Letter of Interpretation - 172.204.pdf\nHi Alice,\nAttached is the PDF for LOI 19-0081.\nThanks,\nLynsie, HMIC\nFrom: William Herman [mailto:wherman@natc-inc.com]\nSent: Wednesday, June 12, 2019 4:32 PM\nTo: INFOCNTR {PHMSA) <INFOCNTR.INFOCNTR@dot.gov>\nSubject: Request for Guidance/Interpretation\nSir/Madam,\nI have attached a request for interpretation regarding shipper certification. I have searched previous guidance documents on your\nwebsite and could find none specific to my concern.\nPlease find attached documents relative to this request.\nThank you for your attention in this concern.\nMy apologies if this email is duplicative, as I received an error message with my previous to infocntr@dot.gov\nRegards,\nWilliam Herman\nNATC, Inc.\nPO Box 1440\nHightstown, NJ\n0-609-426-0555\nC-732-330-6392\n1\n\n<<<PAGE 3>>>\n\nMr. Shane Kelley\nDirector, Standards and Rulcmaking Division\nU.S. DOT/PHMSA (PHH-10)\n1200 New Jersey Avenue. SE East Building, 2nd Floor\nWashington, DC 20590\nJune 12, 2019\nDear Mr. Kelley,\nI am requesting an interpretation regard ing shipper certification. l have attached a copy of a\nroadside inspection conducted by the New York State Police and have also attached a copy of the\nshipping paper associated with this inspection.\nThe trooper cited the carrier for a violation of §177.817(6) -·· \"Shipper's certification contains a\nmisspelling, 'accurately' is spelled ·accuratly' within the certification.'·\nSince this was a cargo tank supplied by the carrier. and as§ 172.204(6)( 1 ){i ), as well as§ I 77.8 l 7(b)\nconfer, no shipper certificat ion would be required.\nThis violation was challenged through the Data Q website on the basis that since no certification\nwas required, this was essentially optional language and therefore not subject to the strict language\nlirnitation as set forth in § 172.204(a)(2).\nThis request was denied by the agency as they assert that the misspelling is a \"modification·· to the\nlanguage prescribed in the section. They point to interpretations issued by your agency wherein\nPHMSA has stated that no modification to the language in subparagraphs (I) or (2) is permit1ed\nor authorized. I have reviewed these interpretations and it appears they all pertain to ··required''\nshipper certifications. They further asserted that since the shipping paper contained this\ncertification statement, it must be in conformance with the regu lation in all regards.\nI am formally requesting PHMSA provide guidance on;\n1. If a shipper certification appears on a shipping paper when one is not required, must it\notherwise confonn to the section in the same manner as is prescribed in. for example, the\npermissive placarding section?\n2. If the answer to question l above is yes, does the misspelling of the word .. accurately ..\nconstitute a bona fide modification to the language prescribed in§ I 72 .204(a)(2)?\nThank you,\nWilliam Herman\nNorth American Transportation Consultants\nPO Box 1440\nHightstown, NJ 08520\n609 426-0555\n\n<<<PAGE 4>>>\n\nNEW YORK STATE POLICE\nCommercial Vehicle Enforcement Unit\nTroop C\nDRIVER/VEHICLE EXAMINATION REPORT\nReport Number: NYSPC0191377\nInspection Date; 05122/2019\nStart Time: 08:21 AM End Time: 09:01 AM\nlnsp.
