Specifically, you ask whether the HMR prohibits the transportation of a filled or partially\nfilled CTMV on a RGN trailer.\nThe answer is no, the HMR does not prohibit the transportation of a filled or partially filled\nCTMV on a RGN trailer. Please note that all applicable HMR requirements, including hazard\ncommunication such as markings and placards, continue to apply when the filled or partially\nfilled CTMV is the object of carriage, rather than the actual vehicle used to transport the\nhazardous material cargo. Also, please be aware that§ 177.834(a) requires that the CTMV be\nsecured against shifting during transportation while loaded on the RGN trailer.\nI hope this information is helpful. Robert\nfrom the DOT customer service center contacted us to advise it would be allowable as long as the vehicles are approved\nbulk fuel containers. In order to confirm to the carriers this is true, we are asking to be sent an official letter of\ninterpretation on the matter.\nTo restate our question:\nWe are looking to move fuel trucks that are filled with fuel by loading them onto RGN trailers. During the shipment they\nwould be filled with DG fuels such as UN1202 and UN1978 (SDS's attached). The vehicles we would be moving are DOT\napproved as bulk containers. We would use them as single packaging on the RGN trailer to carry the fuel to destination.\nWe would like an official letter of interpretation to state that this is allowable under DOT /PHMSA guidelines.\nRequesting Party:\nACA International LLC\nDOT# 3107313\nMC #80822\n129 Newbury Street\n2nd Floor\nBoston, MA 02116\n646-843-0700\nPlease let me know if you have any questions or if I can further clarify what we are looking for in our letter.\n1\n\n<<<PAGE 3>>>\n\nThank you!\nBest Regards,\nTim Farrell\nACA International LLC\n\"The Charter and Logistics Specialist\"\nAviation • Logistics • Consulting\nT +l.646.843.0700\nF + 1.646.381.3629\nM +l.203.525.3100\nTim@aca-int.com\nwww.aca-int.com\nCharter Requests: charters@aca-int.com\nOn Tue, Jul 30, 2019 at 2:05 PM Portia Corsetti <portia@aca-int.com> wrote:\nHello Info center.\nI have a customer who owns a fuel company and they are looking for assistance to move their fuel tankers from the\neast to the west coast over the road. For massive fire, use unmanned hose\nholders or monitor nozzles; if this is impossible, withdraw from area and let fire burn. Water runoff\ncan cause environmental damage. Use compatible foam to minimize vapor generation as needed.\n6. Accidental release measures\nPersonal precautions,\nprotective equipment and\nemergency procedures\nMethods and materials for\ncontainment and cleaning up\nEnvironmental precautions\nKeep unnecessary personnel away. Local authorities should be advised if significant spills cannot\nbe contained . Keep upwind. Keep out of low areas. Ventilate closed spaces before entering. Do\nnot touch damaged containers or spilled material unless wearing appropriate protective clothing.\nSee Section 8 of the SOS for Personal Protective Equipment.\nEliminate all ignition sources (no smoking, flares, sparks, or flames in immediate area). Local\nauthorities should be advised if significant spillages cannot be contained. Stop leak if you can do\nso without risk. This material is a water pollutant and should be prevented from contaminating soil\nor from entering sewage and drainage systems and bodies of water. Dike the spilled material,\nwhere this is possible. Prevent entry into waterways, sewers, basements or confined areas.\nUse non-sparking tools and explosion-proof equipment.\nSmall Spills: Absorb spill with vermiculite or other inert material, then place in a container for\nchemical waste. Clean surface thoroughly to remove residual contamination. This material and its\ncontainer must be disposed of as hazardous waste.\nLarge Spills: Use a non-combustible material like vermiculite, sand or earth to soak up the product\nand place into a container for later disposal. Prevent product from entering drains. Do not allow\nmaterial to contaminate ground water system. Should not be released into the environment.\nClean up in accordance with all applicable regulations.\nIf facility or operation has an \"oil or hazardous substance contingency plan\", activate its\nprocedures. Stay upwind and away from spill. Wear appropriate protective equipment including\nrespiratory protection as conditions warrant. Do not enter or stay in area unless monitoring\nindicates that it is safe to do so. Isolate hazard area and restrict entry to emergency crew.\nFlammable. Review Firefighting Measures, Section 5, before proceeding with clean up. Keep all\nsources of ignition (flames, smoking, flares, etc.) and hot surfaces away from release. Contain spill\nin smallest possible area. Recover as much product as possible (e.g. by vacuuming). Stop leak if it\ncan be done without risk. Use water spray to disperse vapors. Use compatible foam to minimize\nvapor generation as needed. Spilled material may be absorbed by an appropriate absorbent, and\nthen handled in accordance with environmental regulations. Prevent spilled material from entering\nsewers, storm drains, other unauthorized treatment or drainage systems and natural waterways.\nContact fire authorities and appropriate federal , state and local agencies. If spill of any amount is\nmade into or upon navigable waters, the contiguous zone, or adjoining shorelines, contact the\nNational Response Center at 1-800-424-8802.
