In accordance with§ 178.337-9(c), each cargo tank inlet and outlet, with the\nexception of gauging devices, thermometer wells, and pressure relief devices, must be marked\n\"liquid\" or \"vapor\" to designate whether it communicates with liquid or vapor when the cargo\ntank is filled to the maximum permitted filling density. Provided the marking is readily visible,\nlegible, durable to withstand transport conditions, and clearly associated with the corresponding\ninlet/outlet, the marking would satisfy the requirements of the HMR. The marking(s)\nrequirement may be satisfied using various locations and methods, including marking on the\ncargo tank shell.\nI hope this information is helpful. Please contact us if we can be of further assistance.\nSincerely,\n~r#~~~\nT. The requester spoke with me in the HM IC. I offered him letter 17-\n0020 and 17-0040 and advised him that the guidance ends at \"Provided the marking is readily visible, legible,\ndurable to withstand transport conditions, and clearly associated with the corresponding inlet or outlet,\nmarking in the locations you describe would satisfy the requirements of the HMR.\" He decided he wanted to\nrequest for an LOI for his situation so that he can fight his violation .\nIf you have any questions, please contact our office.\nThanks,\nKathryn, HMIC\nFrom: Clayton Droste [mailto:Clay.Droste@nutrien.com]\nSent: Thursday, October 10, 2019 11:36 AM\nTo: INFOCNTR (PHMSA) <INFOCNTR.INFOCNTR@dot.gov>\nSubject: CFR Interpretation Request\nGood Morning,\nI'm writing to request an interpretation related to CFR 178.337-9C. We were stopped in Umatilla, OR and cited under\n178.337-9C. The inspector noted \"MC331 inlets and outlets not marked as required . Inlets and outlets marked by a\ncolor code above the lines on tank surface. I have attached a photo of the tank in question and believe that we have met\nthe statutory intent of the regulation .\nI've looked at all of the interpretation letters on your website . Although some are close (17-0040) specifically, I provided\nthis document to the Oregon DOT and they disagreed. ODOT explained that I would need an interpretation from\nPHMSA that specifically deals with the markings that are currently on the tank (photo attached to this request).\nI look forward to hearing back from you.\nThanks,\nClayton Droste\nSupervisor, Transportation Regulatory\nProduct Stewardship & Regulatory Affairs\n3005 Rocky Mountain Ave\nLoveland, CO 80534\n1\n\n<<<PAGE 3>>>\n\nt 970-685-3857 C 970-397-7016\nclay.droste@nutrien .com\nwww.nutrien.com\n, utrien·\nFor more information on Nutrien's email policy or to unsubscribe, click here: https://www.nutrien.com/important-\nnotice\nPour plus de renseignements sur la politique de courrier electronique de Nutrien ou pour vous desabonner, cliquez\nici: https://www.nutrien.com/avis-important\n2\n\n<<<PAGE 4>>>\n\nl,CH1l\n,I\nLIQUID-ORANGE\nVAPOR-YELLOW\n.,\nI\n... ......\n,","truncated":false,"body_characters":3980}
