You state that your firm manages hazardous and\nnon-hazardous waste for waste generators, and you are currently working with a DoD installation\nin Colorado named Pueblo Chemical Depot (“the depot”). You state that the depot has\ncontamination of various constituents of concern1 throughout the facility where a specific area\nwas identified as being in contact with explosive nitro-aromatic compounds (e.g., TNT,\nDinitrotoluene, RDX, etc.). You state that these compounds have contaminated the groundwater\nand you state that analysis of the post treatment groundwater samples display traces of certain\nexplosive compounds at approximately 0.053 µg/l. You ask questions regarding the applicability\nof the Pipeline and Hazardous Materials Safety Administration (PHMSA) explosive approval\nprocess for waste generated with trace amounts of these constituents of concern. We have\nparaphrased and answered your questions as follows:\nQ1. You ask whether any debris (e.g., personal protective equipment (PPE)) that may have\nbeen exposed to waste streams containing trace amounts of explosive compounds must\nhave an explosives examination report submitted to PHMSA for review under the\nexplosive approval process.\nA1. The answer is yes. Waste material that is exposed to and contaminated with explosive\ncompounds is considered a “new explosive.” A new explosive is an explosive produced\nby a person who has not previously produced that explosive or has previously produced\nthat explosive but has made a change in the formulation, design, or process to alter any of\nthe properties of the explosive (see § 173.56). The term “formulation”\n—as used in the\ndefinition of a new explosive—applies to the entire mixture and not just the explosive\ncomponents. Any changes must be examined to determine whether the properties have\nbeen altered and this may not be self-determined but must be determined in accordance\n1 Any substance defined as a hazardous substance, hazardous waste, hazardous material, toxic substance, solid\nwaste, pollutant, or contaminant by an Environmental Law (https://www.lawinsider.com/dictionary/constituent-of-\nconcern).\n\n<<<PAGE 2>>>\n\nwith § 173.56(b). If the explosive compounds are mixed with filters, rags, dirt, or other\nmaterial (e.g., diluted with contaminated water or other solvents), it is considered a “new\nexplosive” and must be approved in accordance with § 173.56(b).\nHowever, it is the shipper’s responsibility to determine whether a specific piece of waste\nmaterial generated from the site is contaminated with explosive residue. Please note, if\nfurther process to decontaminate or neutralize contaminated PPE before declaring it as\nwaste or if further sampling indicates there is no longer detectable explosive content, it\nwould be possible to determine the PPE is no longer an explosive hazardous material.\nQ2. You believe that the contaminated water would be considered non-hazardous waste based\non the trace amount of explosive compound identified in the groundwater and you ask\nwhether the HMR has allowances for a de minimis quantity exception for explosive\nmaterial. You also seek confirmation that assigning a non-regulated hazardous material\ndescription for the material is appropriate and would not warrant submission and review\nin accordance with the requirements found in § 173.56(b).\nA2. The answer is no. All compositions containing any amount of explosive material—\nincluding compositions of diluted (desensitized) explosives or explosives combined or\ncontaminated with other materials—meet the definition of a new explosive and must be\nclassified and approved by PHMSA. However, this process may result in a determination\nthat the material is not an explosive and thus not regulated.\nPlease note that in accordance with § 173.56(i), if experience or other data indicate that\nthe hazard of a material or a device containing an explosive composition is greater or less\nthan indicated according to the definitions and criteria specified in §§ 173.50, 173.56, and\n173.58, the Associate Administrator may specify a classification or except the material or\ndevice from the requirements of the HMR.\nI hope this information is helpful. The Army worked\nwith the State of Colorado (CDPHE) to identify and establish corrective action measures for various\nareas of concern throughout the site, which brings us to my question.\n\n<<<PAGE 4>>>\n\nSolid Waste Management Unit (SWMU 17) is an area that came in contact with explosive materials\nyears ago that eventually contaminated the ground water. Nitro-aromatic compounds (TNT, Dinitro-\ntoluene, etc), RDX, etc.) have been identified in the ground water. A Corrective Action measure,\napproved by the State, calls for the ground water to be extracted, treated and reinjected back to\nground, and to take quarterly samples from monitoring wells.\nMost recent analysis of the water shows traces of certain explosive compounds at 0.053 ug/l.\nExcerpts from the analysis and a more detailed discussion of the history of the site and the\ncorrective action measures are outlined in the attached file.\nThe generator is trying to profile non-hazardous PPE and debris from this process. The debris may or\nmay not have come in direct contact with ground water containing trace levels (0.53ug/l) of\nexplosive compounds.\nThe disposal firm (Clean Harbors) is asking for an EX number demonstrating that the generator has\nmade a submission of this “material” (non-hazardous waste), as a “newly manufactured” explosive\nfor review and concurrence by PHMSA. The generator maintains that this is not necessary, as this\nnot a new explosive and nothing is being manufactured. This is simple a non-hazardous waste, that\nhas been generated during implementation of corrective action measures, that may or may not have\ncome in contact with water, that may have de minimus traces of explosive compounds. Environmental sampling equipment (inoperable submersible pump, bailer filters, and\nfilter cartridges) and related waste (decontamination paper towels, personal protective equipment\n[PPE], and sampling debris) was generated during groundwater sampling and operation and\nmaintenance (O&M) event. The waste was generated from Corrective Action activities conducted in\naccordance with the Pueblo Chemical Depot (PCD) Resource Conservation and Recovery Act\n(RCRA) Hazardous Waste Permit No. CO-13-12-23-01 (the Permit). As detailed herein, the wastes\nhave been characterized pursuant to 6 Code of Colorado Regulations (CCR) 1007-3, §262.11.\nSite Description and RCRA Status\nThe Trinitrotoluene (TNT) Washout Facility and Discharge System is located in the southwestern\nportion of PCD within the Western Wildlife Management Reuse Area. From the late 1940s to 1974,\nTNT from various munitions was reclaimed at the TNT Washout Facility. A pump and treat system for\ncontaminated groundwater at SWU 17, called the Southwest Terrace (SWT) Groundwater\nExtraction, Treatment, and Injection (GETI) System, was installed and operational since June 2001 to\nstop offsite migration of contaminated groundwater from the SWU 17 Southwest Terrace (SWT)\narea. The SWT area covers approximately five square miles extending from northwest of the TNT\nWashout Facility to the western and southern boundaries of PCD. This area includes a portion of\nChico Creek. The GETI system has three distinct and separate areas of groundwater extraction,\ntreatment, and reinjection: Ciruli Spring, South Point, and Southwest.\nExpected Waste Contaminants\nSWU 17 (TNT Washout Facility and Discharge System) is the source of explosives-related\nconstituents in soil and groundwater in the SWT area. Explosives such as hexahydro-1,3,5-trinitro-\n1,3,5-triazine (RDX), 2,4-dinitrotoluene (2,4-DNT), 2,6-dinitrotoluene (2,6-DNT), and\n1,3-dinitrobenzene (1,3-DNB) are detected above the Colorado Groundwater Quality Standards\n(CGWQSs) in the groundwater within the facility boundary.\nThe Permit identifies octahydro-1,3,5,7-tetranitro-1,3,5,7-tetrazocine (HMX), RDX,\n1,3,5-trinitrobenzene, 1,3-DNB, tetryl, nitrobenzene, 2,4,6-TNT, 4-amino-2,6-dinitrotoluene, 2-amino-\n4,6-dinitrotoluene, 2,4-DNT, 2,6-DNT, 2-nitrotoluene, 3-nitrotoluene, 4-nitrotoluene, pentaerythritol\ntetranitrate (PETN), and nitrate as contaminants of concern (COCs) in groundwater. The selected\nPage 1\n\n<<<PAGE 11>>>\n\nAccumulation Area (SAA) drum addressed in this letter.\nPurged Groundwater Characterization\nTable 1 presents the waste drum ID along with the associated laboratory analytical file IDs of the\ngroundwater sampled during the period solid waste was accumulated in drum 21PCD0232.\nGroundwater samples associated with solid waste contained in this drum were analyzed for\nexplosives using USEPA Method SW8321B and nitrate by method USEPA SW9056A.\nThere were no listed waste compounds detected. However, toxicity characteristic (TC) waste\nconstituent 2,4-DNT, as well as a number of other site-related hazardous and non-hazardous\nconstituents, were detected in the purged groundwater collected during the period SAA drum\n21PC0232 accumulated PPE and O&M solid waste.\nNone of the detected TC waste constituents exceeded the USEPA Toxicity Characteristic Regulatory\nLimits (TCRLs) in the purged groundwater associated with the solid waste in the drum addressed in\nthis letter. Accordingly, \"D\" codes are not applicable to any of this waste.\nTC waste constituent 2,4-DNT, as well as RDX, were detected above the CGWQS. However these\nare not listed waste constituents, and therefore this waste is considered non-hazardous.\nOther site-related hazardous constituents detected in the purged groundwater associated with the\nsolid waste in the drum addressed in this letter were below the associated CGWQSs, and therefore\nhave no bearing on the waste classification.\nTable 1 also shows the proposed waste codes, proposed waste code justification, and the proposed\nwaste disposition. Table 2 provides a tabulation of the groundwater sample detections, and\ncompares the concentrations to the TCRLs and CGWQS.\nPPE and Sampling Debris Characterization and Disposition\nThe PPE and sampling debris generated during this groundwater sampling event was contained\nwithin SAA drum 21PCD0232 at the time of the sampling that was stored in the Ciruli Spring\ntreatment building CS 6A at SWU 17 in the GETI Area.
