No. 98-0053\n409 Broad Street - Suite 260\nSewickley, PA 15143\nDear Ms. Ferragonio:\nThis is in response to your letter dated May 8, 1998, regarding the applicability of the\nHazardous Materials Regulations (HMR; 49 CFR Parts 171-180) to ferrosilicon, with 75\npercent silicon.\nThe Hazardous Materials Regulations govern the transportation of hazardous materials in\ncommerce. Under 49 CFR 173.22, it is the shipper's responsibility to properly classify a\nhazardous material. Such determinations are not required to be verified by this office.\nBased on the test results you provided, it is our opinion that the ferrosilicon manufactured by\nyour company does not meet the criteria of a Division 4.3 and provided it does not meet any\nother hazard class, it is not subject to the HMR.\nI hope this satisfies your inquiry.\nSincerely,\nShe Billip\nDelmer F.
