No: 98-0169\n12270 Cherrywood St.\nBroomfield, CO 80020\nDear Mr. Williams:\nThis is in response to your letter of June 21, 1998, requesting\nclarification on the requirements for limited quantity shipments\nof compressed gas under the Hazardous Materials Regulations\n49 CER Parts 171-180).\nIn your letter you describe a small\n• (HMR;\nballoon signaling device with an alloy steel cylinder pressurized\nballoon inflation\nto approximately 7,000 psi packaged as an integral part of the\nmarketed\nmechanism. The whole device is intended to be\nto the public as a retail item.\nis non-refillable and has an internal volume of less than 7.2\nThe cylinder of helium\ncubic inches. Your questions have been paraphrased and answered\nas follows:\nQ1. You first asked us to confirm that your cylinders would\nqualify for the limited quantity provision.\nAl.\nSection 173.306 (a) excepts certain limited quantities of\ncompressed\n• gases from labeling (except when offered for\ntransportation by air) and, unless otherwise required, the\nspecification packaging requirements when packed in\naccordance with the provisions in § 173.306. The limited\nquantity provision excepts compressed gases when in\ncontainers of not more than 4 fluid ounces capacity (7.22\ncubic inches or less) except cigarette lighters\n($ 173.306 (a) (1)). In addition, each package must not\n30 kg (66 pounds) gross weight. Assuming that each\nof your packages does not exceed 66 pounds gross weight,\nit appears that your scenario would meet the conditions\nof this limited quantity exception.\nQ2.\nOther than normal OSHA standards, are there any other\nshipping or transportation of\ngovernment or DOT regulations regarding the manufacture,\nthis nature that we must comply with?\na pressurized cylinder of\n173,306\n\n<<<PAGE 2>>>\n\n2\nA2.\nIf the helium cylinders described in your scenario meet the\nlimited quantity provisions, the cylinders would not have\nto meet the specification packaging requirements and, if\nthe HMR.\nnot transported by aircraft, the labeling requirements of\nShipments of compressed gases packaged in limited\nquantities must comply with all other requirements in the\nHMR from which they have not been excepted.\n23.\nWill the DOT need to be involved in reviewing manufacturing\nfacilities or destructive testing data prior to the start\nof production this summer?\nA3.\nIf the cylinders do not meet the limited quantity\nprovisions, they would be required to meet the\nspecification packaging requirements in 49 CFR Part 178,\nand be re-tested in accordance with § 173.34 (e). For most\ncylinders, inspections and verifications required by Part\n178 must be performed by an independent inspection agency\napproved in writing by the Associate Administrator, in\nDE.\"\naccordance with § 173.300a (§ 178.35 (b) (1)). DOT is not\ndirectly involved with the review of manufacturing\nfacilities or destructive testing data prior to the start\nof production.\n24. Does this item qualify to be classified as an ORM-D\nmaterial?\nA4.\nAdditional exceptions are provided in § 173.306 (h) for\nlimited quantity shipments of compressed gases which meet\nthe definition for consumer commodity. A limited quantity\nwhich conforms to the provisions of $ 173.306 (a) (1),\n(a) (3), or (b) and is a \"consumer commodity\" as defined in\n§ 171.8, may be re-named \"consumer commodity\" and re-\nclassed as ORM-D material. Assuming that your helium\nCylinders meet the limited quantity provisions of\n§ 173.306 (a) (1), and the signaling devices meet the\ndefinition of \"consumer commodity\" in § 171.8, Your\nmaterial may be re-classed as ORM-D material, and\n*.\nqualify for the exceptions in § 173.306 (h).\n\n<<<PAGE 3>>>\n\n3\n25.\nWhat labeling and shipping paper requirements would pertain\nto this product for normal ground transportation, if any?\nA5.\nEach package containing an ORM-D material must be marked on\nat least one side or end with the ORM-D designation\n($ 172.316). The cylinder will be packaged as an integral part of the balloon inflation\nmechanısm, and is intended to be marketed to the public as a retail item. This cylinder will be a\nnon-refillable high pressure helium cylinder that has an internal volume of less than 7.2 cubic\ninches. Attached is a drawing of the proposed cylinder.\nSo that my client can be in strict regulatory compliance, could you please address the following\nquestions in writing. Please be specific.\nThe table in 49CFR172.101 classifies compressed helium as a Hazard Class 2.2 material, and\neterences 49CFR173.306 as a packaging exception.
