Specifically, as stated in your letter, an\noverseas customer is requesting that you furnish documentation\nfrom this Department to confirm that Spectra Gases, Inc. has\ncorrectly classified the gas mixture in question.\n•:\nUnder 49 CFR 173.22, it is the shipper's responsibility to\nproperly classify a\nhazardous material:\nSuch determinations are\nnot required to be verified by this Office.\nmanufacturer of a material has the knowledge to properly classify\nGenerally, the\nto initial shipment.\nand is required to properly classify the hazardous material prior\nI hope this satisfies your request.\n:\nSincerely,\nDebor Hill\nelmer F. We provided then with relevant 49 CFR regulations regarding\nSpectra Gases, Inc. has informed our customer that proper shipping names are assigned by the\nlassification of gas mixtures and with our classification process for this mixture in particular. Our\nustomer remains unconvinced that Spectra Gases, Inc. is the final authority regarding assignment of this\n-\nwith documentation provided by DOT Competent Authority (see attached --dated 1985?).\nproper shipping name/classification.
