In other words, a person who performs\nduties that are regulated under the HMR is considered to be a\nhazmat employee. Section 172.704 requires a hazmat employee\nto receive general awareness, function specific, and safety\ntraining.\nBased on the information provided in your letter, your\nemployees perform functions subject to the HMR, such as\nsecuring closures on packagings that contain hazardous\nmaterials, as evidenced by the signed customer certification\nwhich states in part that \"all closures are in place and have\nbeen secured\nas required by 49 CFR 173.29 (a) and\n173.24 (b) (1) \"\nAny employee who performs a function covered\nby the HMR, e.g., secures these closures, is a hazmat\nemployee.\n\n<<<PAGE 2>>>\n\nSection 172.704 (b) states that training conducted by employers\nthe Occupational Safety and Health Administration (OSHA) of\nto comply with the hazard communication programs required by\nthe Department of Labor (29 CFR 1910.120), to the extent that\ntraining addresses the general awareness, function specific,\nand safety training, may be used to satisfy DOT training, in\norder to avoid unnecessary duplication of training.\nI hope this satisfies your request.\nSincerely,\nfor that. When the drums are\nempty, the chemical company picks up the empty drums.\nThe chemical company provides the paperwork, etc. Our facility simply allows the\nempty drums tobe picked up.\n:\n:\n.. All of our employees have had the OSHA required Haz Com training.
