George Gaskill\nLockheed Martin\n199 Borton Landing Road\nMoorestown, NJ 08057-0927\nDear Mr. Gaskill:\nThis is in response to your letter regarding the applicability of\nthe Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180)\nto manufactured articles containing limited quantities of\nhazardous material.\nYou state that\nshipping names \"Ethyl; ether, \" UN1155, PG I and \"Pentanes, \"\nyou are using the proper\nUN1265, PG I for transporting these manufactured articles\nrequest confirmation of your understanding of the limited\nand\nquantities provision ($ 173.150) specified for these entries in\nthe exceptions column of the Hazardous Materials Table.\nYou are correct in your understanding of the limited quantity\nexceptions for Class 3 (flammable liquids) as provided in\n$ 173.150. For Packing Group I materials, an inner packaging may\nnot exceed\n• 1 gallon\nnot exceed 66 pounds. Although the quantity of hazardous\nand the gross weight of the packaging may\nmaterial in your manufactured articles is less than .1 gallon,\nthe gross weight of each article is over 66 pounds.\nyour manufactured articles do not meet the requirements for the\nTherefore,\nlimited quantity exceptions in § 173.150.\nYou may wish to contact the Research and Special Programs\nAdministration's Office of Exemptions and Approvals. Exemptions\ncertain requirements under the HMR.\nare granted on a case-by-case basis to authorize the relief of\nProcedures for applying for\nan exemption are set forth in § 107.105 of the HMR. Exception to regulations requirements for a finished article\n1. We purchase manufactured assemblies containing a small\nquantity of flammable material. The material(s) are 2-Methyl\nbutane or a mixture of Ethyl Ether and 2-Methyl butane. Section\n173.150 exceptions are referenced in the 172.101 table of CFR 49.\nThe table 172.101 shows Ethyl Ether on P.171 (UN1155) and 2-\nPentane) and P.2230 (Downes 1) (UN 1265), boph me ters 1\" are\nshown as Class III, group 1)\n4. Ihe total quantity contained in the manutactured assembly (a\ntemperature contro, valve) is less than 1 gallon. (Vrothgal lon\n3. The manufactured article containing the small quantity weighs\nmore than 66 Ibs.\n4. Our understanding is that the weight of the article (valve) is the\nfactor that incurs the regulatory requirements (performance\npackaging and labeling) in shipment, whereas it would otherwise\nbe exempted if it weighed less (assuming the same quantity of\nhazardous material).\n5. The regulations performance packaging adds considerable cost\nand complexity in shipping, both for our supplier and ourselves.\nHave we understood the requirements correctly?\nCan DOT explain the reasoning behind the requirements\nexemption for shipping devices with limited quantities of\nhazardous material, in particular the effect of the device weight on\nthe exemption?","truncated":false,"body_characters":4330}
