Specifically, you\nask about the definition of \"loading\" as it applies to highway\ntransportation of hazardous materials.\n\"Transportation\" as defined in $ 5102 of the federal hazardous\nmaterials transportation law (49 U.S.C. 5101-5127) is any\nmovement of property by any mode, and any loading, unloading,\nor storage incident to the movement.\n\"Loading\" is not\nspecifically defined in the law nor is it specifically defined\nin the HMR. For highway transportation of hazardous\nmaterials, \"transportation\" begins when a motor carrier\naccepts and assumes responsibility for a shipment.\nThe scenario presented in your letter involves a driver moving\na manifested and labeled drum from a storage area to his\nvehicle.\nThe driver's actions are an indication that the\nmotor carrier has accepted the drum for shipment.\nTransportation of the shipment has therefore begun. The\nmovement from storage\narea to vehicle is considered to be\nLoading incidental to transportation, and reporting of the\nspill\nunder S$ 171.15 or 171.16 of the HMR is required\nI hope this information is helpful.
