Specifically, you ask\nwhether a military shipment of Helium, compressed, 2.2, UN1046\ntransported by commercial aircraft is subject to the HMR.\nThe answer is yes. As provided in § 171.1, the HMR apply to\nany department, agency, or instrumentality that transports or\ncauses to be transported or shipped hazardous materials in\ncommerce.\n\"In commerce\" means transportation for commercial\npurposes or the use of for-hire interstate carriers by a state\nagency or local jurisdiction to transport hazardous materials.\nYour shipment of Helium, compressed by commercial aircraft\nwould be considered in commerce.\nI hope this satisfies your request.\nSincerely,\nMess\nJohi\nA.
