No. 99-0076\nCommercial Vehicle Consultant\n23076 Dune Mear Road\nLake Forest, CA 92630-3933\nDear Mr. Wood:\nThis is in response to your inquiry concerning whether the use of\npermissible under the Hazardous Materials Regulations (HMR; 49\ntwo different primary hazard labels for the same hazard class is\nGAS or TOXIC GAS label and the new poison inhalation hazard (PIH)\nCER Parts 171-180).\nSpecifically, you inquire whether\nlabel may be displayed on\na cylinder containing Sulfuryl\nfluoride, 2.3, UN2191. The International Maritime Dangerous Goods\nCode does not provide for the display of the PIH label as\nrequired by the HMR effective\nOctober 1, 1999.\nThe answer\nto your question is yes, the dual display of the old\nPOISON GAS\nor TOXIC GAS label and the new PIH label is\nacceptable.\nThe old label represents the hazard of material in\nthe package and is required under the International Maritime\nDangerous Goods (IMDG) Code.\nIts continued use under the HMR is\nacceptable as specified in $ 172.401 (a) (2) and (c)\nrespectively.\nIn\na recent\ninterim final rule (September 16, 1999; HM-206D; 64\nFR 50260), we provided a\ntransition period until October 1, 2001,\nthe old POISON GAS or TOXIC GAS label in accordance with the IMDG\nto allow\na package containing a PIH material to be labeled with\nCode, subject to the following conditions and limitations:\n(1)\nThe material must be packaged in accordance with the\nHMR;\n(2)\nThe package must be marked \"inhalation hazard\" in\naccordance with § 172.313 (a);\n(3)\nThe package must be transported in a closed transport\nvehicle or freight container that is marked with the\nidentification number for any quantity of PIH materials\nas prescribed in § 172.313 (c);\n172.401\n990076\n\n<<<PAGE 2>>>\n\n:\n(4)\nIf a closed transport vehicle or freight container\nwith the identification number determined according to\ncontains more than one PIH material, it must be marked\n$ 172.313 (C) (3); and\n(5) A closed transport vehicle or freight container must be\nplacarded as required by subpart F of part 172 of the\nHMR.\nI trust this satisfies your inquiry. DOW\nfollowing subject. Is it permissible to display on a gas\nAGRO is currently displaying the new poison inhalation\nhazard label and the old poison gas label on the same\ncylinder, next to each other. Both labels display the class\nnumber at the bottom of the label. The reasoning that was\nDOT poison inhalation hazard label, and that they ship some\ngiven for doing this is, that IMO does not recognize the Us\ncylinders overseas. The product in the cylinders is Sulfuryl\nFluoride 2,3 UN2191 . There is no subsidiary hazard\nindicated.
