Shipments\nof hazardous materials transported by a government entity in\nvehicles operated by government personnel for noncommercial\npurposes are not subject to the HMR. However, if the purpose\nis commercial or if the government entity offers hazardous\nmaterial for transportation to commercial carriers, then the\nHMR apply.\nI hope this satisfies your request.\nSincerely,\nJohn A. Billings\nChief, Regulations Development\nOffice of Hazardous Materials Standards\nUS Department of Transportation\n400 Seventh Street SW\nWashington DC 20001\nSUBJECT: Applicability of HAZMAT Regulations to Government Agencies.\nDear Mr. Billings,\nThis is a request for help from your office. I am assigned to a US Army Reserve\nTransportation Company and am responsible for managing a fleet of 60 trucks and fuel\ntankers. Attached is a letter from you dated 23 FEB 95. I am requesting that you review\nthe letter and if it still applies, send me an updated copy.\nThe information in your letter is used to avoid placing inspection stickers on our vehicles.\nWe have Radar Absorbing paint (CARC PAINT) on our vehicles and placing these\nstickers on our vehicles invalidates the paint.\nWe have our own internal requirement to purge our fuel tankers on a yearly basis and\ncomplete this requirement without fail. Again, we are only asking for relief from the\nrequirement to place inspection stickers on our vehicles.\nIn the past, the Michigan DOT has accepted this letter in lue of the inspection stickers.\nAny help you can give me in this matter would be greatly appreciated.\nThank You,\nSFC, USA\nTRUCKMASTER","truncated":false,"body_characters":2557}
