No. 99-0141\nRegulatory Manager\nAustin Powder Company\nCleveland, OHIO\n44122\nDear Mr. King:\nThis is in response to your letter dated June 3, 1999,\nSpecifically, you ask if a CARGO AIRCRAFT ONLY label may be\nregarding the use of the CARGO AIRCRAFT\nONLY label:\nplaced on\na package containing a hazardous material that is\nauthorized aboard a passenger-carrying aircraft.\nColumn 9A of the Hazardous Materials Table specifies the\nmaximum net quantity of a hazardous material that is\nauthorized to be\ntransported aboard a passenger-carrying\naircraft.. Section 173.27 states that a package containing a\nhazardous material which is authorized\naboard cargo aircraft\nbut not aboard passenger aircraft must be labeled with the\nCARGO AIRCRAFT ONLY label and may not be offered for\ntransportation or transported aboard passenger-carrying\naircraft. It is the opinion of this Office that a package\nbearing the CARGO AIRCRAFT ONLY label that is within the\nquantity limitations specified for passenger-carrying aircraft\nwould not be\nin violation of the Hazardous\nMaterials\nRegulations.\nI hope this satisfies your inquiry.\nSincerely,\nDelm Fill\nThomas G.
