You have\nindicated that the material has been classified outside the\nUnited States and the competent authority of the country of\norigin has provided a dispensation from the explosive\nsubsidiary risk in accordance with the provisions of the\nInternational Maritime Dangerous Goods (IMDG) Code.\nSection 171.12(b) of the U.S. Hazardous Materials Regulations.\n(HMR; 49 CFR Parts 100-185) allows the alternative use of the\nIMDG Code subject to certain conditions and limitations. None..\nof those conditions and limitations restrict the use of the\nIMDG Code in this situation.\nConsequently, azodicarbonamide\nshipped in accordance with the IMDG Code as you have described\nis acceptable. It is also worth noting that the special\nprovisions which you mention in your letter (Special\nProvisions 38\nand 53 in $ 172.102) address provisions similar\n(although stated differently) to those contained in the IMDG\nCode for this material.\nI hope this satisfies your request.\nncerely,\nDelmer F. I also\nhad the opportunity to meet with Commander Corbin and IJ.\nIn pursuit of an interpretation question we have with regard to shipment of\nAzodicarbonamide, UN3242: This product has been classified outside the United States\nand the competent authority of the country of origin has provided a dispensation for the\nexplosive subsidiary risk. The commodity is shipped to the United States in compliance\nwith the IMIDG, section 171.12(b) of the 49CFR; and in compliance with the conditions\nmandated by the competent authority certificate.\nUnder the above circumstances would special provisions 38 and 53 of 171.101 table of\nthe 49CFR be applicable to this shipment?\nWe appreciate your assistance in obtaining an interpretation on this issue.\nSincerely,\nAndalu\nPrabhu Natarajan/\nManager, Corporate Hazardous Materiais\nPN/rgm","truncated":false,"body_characters":2744}
