No. 99-0167\nEnvironmental Health and Safety\nServices\nVirginia Polytechnic Institute\nand State University\n459 Tech Center Drive\nBlacksburg, VA 24061\nDear Mr. Imperatore:\nThis is in response to your letter dated June 24, 1999, and\nsubsequent telephone conversation with a member of my staff,\nregarding the proper packaging and shipping descriptions for\nwaste cyanides\nand brucine under the Hazardous Materials\nRegulations (HMR; 49 CFR Parts 171-180).\nVirginia Tech generates the following materials as waste for\noff site shipment: sodium cyanide; potassium cyanide; and\nbrucine.\nUnder S 173.22, it is the shipper's responsibility to properly\nclassify and describe a hazardous material in accordance with\nParts\n172 and 173.\nSuch determinations are not required to be\nverified by this\nOffice. In the scenario you present in your\nletter you describe all\nthree hazardous materials with one\nproper shipping name, \"Waste toxic solids, inorganic, n.o.s.,\n6.1, UN3288, PG I, (Sodium cyanide, Brucine, Potassium\ncyanide).\"\nThis description is incorrect.\nThe proper\ndescription of each hazardous material offered for\ntransportation is required on the shipping paper\n(S 172.200(a)). In addition, a non-bulk packaging must be\nmarked with the proper shipping name and identification number\nfor each hazardous material in the packaging (§ 172.301). For\nexample, a combination packaging containing inner containers\nof waste sodium cyanide, waste potassium cyanide and waste\nbrucine would be described as follows:\nWaste, sodium cyanide, 6.1, UN1588, PG I\nWaste, potassium cyanide,\n6.1, UN1680, PG I\nWaste, brucine, 6.1, UN1570, PG I\n173.22\n990167\n\n<<<PAGE 2>>>\n\nYou are correct in your understanding that materials meeting\nthe definition of Division 6.1, Packing Group I may not be\npackaged in lab packs (S 173.12 (b) (3)). Materials shipped in\nnon-bulk packagings under the shipping names \"Waste, sodium\ncyanide,\" \"Waste, potassium cyanide\" and \"Waste, brucine,\"\nthat are Packing Group I materials, must be packaged in\naccordance with § 173.211. An outer packaging may contain\nmore than one hazardous material; however, it is the\nresponsibility of the person offering a hazardous material for\ntransportation to ensure that the requirements in S$ 173.21,\n173.24 and 173.24a are met.\nI hope this satisfies your request.\nSincerely,\nWhitfilli\nDelmer F. The shipping container would meet the\nrequirements of a combination packaging as per 49 CFR173.211 (b). The proper DOT shipping\ndescription would be \"Waste Cyanides, inorganic, solid, n.o.s., 6.1, UN1588, PG I (Sodium Cyanide,\nPotassium Cyanide)\". Is this correct?\nDuring a specific three-month period, Virginia Tech may additionally generate 250 grams of Brucine\nin a glass container as waste for off site shipment. It would appear that we could package the Brucine\nwith the cyanides listed above since they are chemically compatible. The shipping container would\nmeet the requirements of a combination packaging as per 49 CFR173.211 (b). The proper DOT\nshipping description would be \"Waste Toxic solids, inorganic, n.o.s, 6.1, UN3288, PG I, (Sodium\nCyanide, Brucine, Potassium Cyanide)\".
