No.\n99-0168\nHMT Associates, L.L.C.\n1850 K Street, N.W., Suite 200\nWashington, DC 20006\nDear Mr. Altemos:\nThis is in response to your June 15, 1999 request concerning the\nlocation of the name plate and requalification markings on a DOT\n51 portable tank.\nThe portable tank in question is in an upright position on its\nends and is enclosed by a square metal configuration.\nAccess to\nthe tank valves, the ASME and DOT specification plates, and the\nrequalification markings is achieved by lifting a hinged top\ncover.\nYou submitted drawings of a portable tank for our review\nand\nasked if the location meets the requirements of the\nregulations.\nThe answer is no.\nSection 178.245-6 requires the name plate with\nthe required markings to be in close proximity to the ASME \"U\"\nstamp certification.\nParagraph UG-116 (j) of the ASME Code states\nthat the markings must be in a conspicuous place on the vessel,\npreferably near a manhole or handhole. With regard to the\nperiodic retest marking, $ 173.32 (e) (3) of 49 CFR requires the\ndate of the most recent\nperiodic retest to be marked on the tank,\non or near the metal certification plate, in accordance with\n$ 178.3.\nSection 178.3 (a) (1) states that the specification\non 17091a1 stan\nmarking must be in an\nMarkings that are\nobscured from view by a cover do not satisfy the requirement for\nan unobstructed area.\nI hope this satisfies your request.\nShould you have any further\nquestions, please contact this office.\nSincerely,\nHattie z. mithell\nHattie I.
