Laurel, NJ\n08054\nDear Mr. Swift:\nThis is in response to your letter dated August 25, 1999,\nregarding markings on non-bulk\nspecification packagings\nunder the\nHazardous\nMaterials Regulations (HMR; 49 CFR Parts 171-180).\nmarked \"94\" must be used prior to the re-test date (12 months for\nSpecifically you ask if a packaging manufactured in 1994 and\nsingle and composite packagings and 24 months for combination\npackagings (§ 178.601 (e))).\nThe answer is no.\nA packaging manufactured prior to the re-test\ndate may be used\nat any time to transport a hazardous material\nfor which it is authorized.\nNon-bulk specification packagings do\nnot \"expire.\"\nHowever, the shipper must determine that the\npackagings has been manufactured, assembled, and marked in\naccordance with the HMR (§ 173.22 (a)) and, if used more than\nonce, must comply with $ 173.28.\nI hope this satisfies your request.\nJohn A. Please send me clarification as to whether or not the packaging is indeed\nusability date. Additionally, commercial airlines would refuse them for transport. Is this\n\"expired \" or if I am still able to use these containers.
