Carr:\nThis is in response to your letter dated October 11; 1999,\nregarding permissive placarding under § 173.502 (c) of the\nHazardous Materials Regulations (HMR; 49 CFR Parts 171-180). In\nyour letter you describe the shipment of combustible liquids\nunder § 173.150 (f) (2). Your questions have been paraphrased and\nanswered as\nfollows:\nQ1.\nMay COMBUSTIBLE placards be displayed on a vehicle\ntransporting a combustible liquid in a non-bulk packaging\nthat is not a hazardous substance, a hazardous waste, or\na marine pollutant.\nA1.\nThe answer is ves.\nSection $ 172.502 (C) permits the\ndisplay of placards for a hazardous material, even when\nnot required, if the placards represent the hazard of the\nmaterial being transported.\nQ2.\nIf a carrier chooses to display placards on a vehicle\ntransporting combustible liquids under the exception in\n§ 173.150 (f) (2), is there a requirement to comply with\nother requirements of the HMR?\nA2.\nThe answer is no.\nshipping paper, marking,\nappropriate placards even when not required, is not\nrequirements.\n173.150\n990291\n\n<<<PAGE 2>>>\n\nQ3.\nIf shipping papers are provided for a hazardous material\nthat is excepted from the HMR, does any violation exist\nif the shipping papers are not executed in conformance\nwith the HMR?\nA3.\nThe answer is yes.\nIf the shipper chooses to provide a\nhazardous\nmaterials shipping paper, the shipper must do\nso in accordance with all the requirements in Part 172,\nSubpart C.\nI hope this satisfies your request.\nSincerely,\nTransportation Regulations Specialist\nOffice of Hazardous Materials\nStandards\n\n<<<PAGE 3>>>\n\nBAH\nFlorida Department of Transportation\n$173.150\nJEB BUSH\nTallahassee, Florida 32399-0450\n605 Suwannee Street\nTHOMAS F. We request written clarification to the following questions:\nliquids in non-bulk packagings, when they are the appropriate placards for the material and are displayed\n1. Are we corréct in assuming that placards may be displayed on a vehicle transporting combustible\ncorrectly?\n2. If the answer to question 1 is yes, if a carrier chooses to placard a vehicle transporting combustible\npackagings, is there any requirement that they comply with any other hazardous material transportation\nliquids which are not hazardous wastes, hazardous substances, or marine pollutants, in non-bulk\nregulation?\n3.
