Box 19771\nHouston, TX 77224\nDear Mr. Mullen:\nI am returning your June 6, 2002 letter in which you asked the\nResearch and Special Programs Administration (RSPA) to \"strike\ndown\" certain requirements of the City of Galveston, Texas\nconcerning the issuance of a permit to load, unload, or transport\nexplosives.\nYou state that \"these\nrules restrict interstate\ncommerce and have not been submitted to RSPA for ratification.\"\nThe Department of Transportation and RSPA do not \"strike down\"\nhazardous materials.\nlocal requirements on the transportation of explosives or other\nA local government (including a city) is\nnot required to submit its requirements to us for \"ratification,\"\ninterstate commerce\nand we do not issue opinions on whether a requirement restricts\ntribe applies for a \"waiver\" of preemption under 49 U.S.C.\n(except when a State, locality, or Indian\n$ 5125 (e)) .\nUnder 49 U.S.C. § 5125 (d), the Department of Transportation\nmay issue an administrative determination that Federal hazardous\nmaterial transportation law preempts a requirement of a State,\nlocal, or Indian tribal government under the criteria set forth\nin 49 U.S.C. § 5125 (a), (b) (1), and (c). RSPA's procedures for\nissuing preemption determinations are contained in 49 C.F.R.\nS§ 107.201 - 107.213. Copies of these sections of the law and\nour procedural regulations are enclosed.\nIf you wish to submit an application for an administrative\ndetermination of preemption,\nyou need to provide the information\nspecified in 49 C.F.R. § 107.203 (b), including why you believe\nthe Galveston requirements are preempted under the preemption\ncriteria in 49 U.S.C. S 5125(a) and (b) (1). You should also\naddress the extent to which the Galveston requirements are\n\n<<<PAGE 2>>>\n\n2\npursuant (or similar) to Captain of the Port or other orders of\n\"authorized by another law of the United States.\"\nthe U.s.
