S5 1801 st ngg., and the Hazardous Materials Regulations\nPetroleum Operations, Inc., operator of the Naval Petroleum\n(HMR), 49 C.F.R. Parts 171-180, to activities of Bechtel\nReserves in California. This letter responds to your inquiries.\nrequirements to Bechtel's liquefied petroleum gas operations.\nFirst, you ask about the application of HMR gas odorization\nI have referred this letter to the Research and Special Programs\nthe office responsible for interpreting the technical require-\nAdministration (RSPA) Office of Hazardous Materials Standards,\nments of the HMR. I understand that you already have sent a\nshould contact her (202-366-4488) with any future questions on\nnearly identical letter to Ms. Jackie Smith of that office; you\nthat subject.\nSecond, you ask whether Bechtel's subcontractors are subject.\nto various HMR requirements when crossing a State highway with\nhazardous materials used in well operations and maintenance.\nThe jurisdiction of the HMTA encompasses hazardous materials\ntransported \"in commerce.\" 49 App. U.S.C. § 1804(a) (1). The\ndefinition of \"in comnerce\" has two elements relevant to your\nsituation.\nFirst, with respect to transportation by notor\nvehicle, the definition encompasses interstate and foreign\ncarriers, and intrastate carriers transporting hazardous\nportable tanks or cargo tanks, and marine pollutants.\nwaste, hazardous substances, flammable cryogenic liquids in\n49 C.F.R.\nor crosses a public way.\n§ 171.1. Second, it enconpasses all transportation that follows\ndescribe is subject to the HMR when it involves an interstate\nAccordingly, the transportation you\nor foreign carrier, or an intrastate carrier transporting any\nof the hazardous materials indicated.\n\n<<<PAGE 2>>>\n\n2\nSome hazardous materials transportation to which you refer,\nsuch as transportation of non-bulk packages that qualify as\nexcepted from certain HMR requirements.
