Porter\nTanks Program Manager\nWest Virginia Department of\nEnvironmental Protection\n601 57th Street SE\nCharleston, WV 25304\nDear Ms. Porter:\nIn a letter to the Pipeline and Hazardous Materials Safety Administration (PHMSA) dated\nDecember 28, 2016, you requested an interpretation of the definition of pipeline facility under\n49 CFR 192.3 in reference to certain aboveground storage tanks used for brine and other fluids.\nYou stated that the aboveground storage tanks in question are used by \"TransCanada/ [Columbia\nPipeline Group] to store brine and other fluids removed in the transportation of gas by pipeline\nby drip separators and to store oil used to lubricate equipment at TransCanada/ [Columbia\nPipeline Group] compressor stations.\" You stated that \"[w]hile these [aboveground storage\ntanks] are located adjacent to a 'pipeline facility', they are not used to 'transport gas in the\npipeline' or to 'treat gas in the pipeline system during the course of transportation\"'. In addition,\nyou provided documentation and previous PHMSA interpretations to support your request for\ninterpretation. You asked whether storage of brine and other fluids aboveground removed from\ngas can be considered part of a pipeline facility and, therefore, regulated and inspected under the\nFederal pipeline safety regulations. ·\nSection 192.3 defines pipeline facility as:\nPipeline facility means new and existing pipelines, rights-of-way,\nand any equipment, facility, or building used in the transportation of\ngas or in the treatment of gas during the course of transportation.\nEquipment used for removal of water and other impurities as treatment of gas meets the\ndefinition of a pipeline facility. However, storage of the waste products (brine and other fluids)\nremoved from gas is not considered a pipeline facility under § 192.3 because after removal, the\nstorage of the fluids is not used in further transportation of the regulated product (gas). In\naddition, both Parts 192 and 195 do not regulate brine or other non-petroleum waste fluids even\nif they are transported by pipeline from the storage tanks. Equipment lubricating oil stored at the\nfacility is not regulated by the Federal pipeline regulations if the oil storage tank is not connected\nto or the oil is not transported by a PHMSA regulated pipeline.\nThe Pipeline and Hazardous Materials Safety Administration, Office of Pipeline Safety provides written clarifications of the Regulations (49 CFR\nParts 190-199) in the form of interpretation letters. The\nEnvironmentalProtection\n(WVDEP)\nappreciatesColumbia\nPipeline\nGroup\nadditionalinformation\ntothe\nAgency concerningthe\napproximatelyfour\nhundredand\nStorageTanks\n(ASTs)that\nColumbia has\nderegistered.We\nunderstandColumbia's\npositionis that these\nASTsarenot\nsubjecttotheASTAct\nbecause\ntheyare\nsubjecttothe NaturalGas\nPipeline\nSafetyActof1968\nand\nregulatedunder\nthe\nDepartmentof\nTransportation\n(DOT)/Pipelineand\nHazardousMaterial\nSafetyAdministration\n(PHMSA).\nSpecifically,Columbia\nassertsthe tanks donot\nstatutorydefinitionofan\nprovisionsfound inWV\nCode,\nChapter22,Article\nThis\nWest\nVirginiaDepartment\nof\n(Columbia) providing\nfifty(450)\nAboveground\nmeetthe\nASTduetothe\n30,\nSection\n3(1)(J).\nIn\n49CFR\nsupportof\nthis\nargument,Columbianoted that the\ndefinitionofa\npipeline facilityunder\n192.3means\"new\nand\nexistingpipelines, rights-of\n-way,and\nany\nequipment,facility,or\nthe\ntransportationof\ngasorinthe\ntreatmentof\ngas\nduringthecourseof\ntransportation.\"\nFurthermore,Columbia notedthat the\ntransportationof\ngasmeans\"the\ngathering,transmission,or\ngasby\npipelineor\nthe\nstorageof\ngas,in\nor\naffectinginterstate\nor\nforeigncommerce.\"\nbuilding\nusedin\ndistribution\nof\nWVDEP\nhas reviewed\ndocuments\npreviouslysubmitted\nbyColumbia and\nWVDEP\ninspectors\nwith Columbia's\nrepresentativesand visited\nanumberof\nColumbia'sASTlocationson\nMay25,\nattemptto\ngainabetter\nunderstandingof\nColumbia's\noperations.WVDEP\nhasdetermined\nin\nquestiontobe\nterminal\npointswhere\nthematerial\n(e.g.condensateand\nproducedwater)has\nremoved from the\ngas\ntransportationstream.\nFurthermore,thematerial in the\nASTsdoesnotre-\nenterthe\ngas\ntransportationstream.\nThematerial in the\nASTsisremoved and\ntransported bytruck for\ndisposalor\nrecycling.The material\nstoredin the\nASTsare\nliquidsnot\nvapor gas,and theASTs donot\nappeartobe\nusedin\nthe\nstorageof\ngas,the\ntransportationof\ngas,orthetreatmentof\nWVDEP\ngas.\nbelievesthe\nstoringvarious\nliquidwastesand\npotentially\nby-products priorto\ndisposalor\nrecycling.In\nbelieves that theASTsare\nsummary,\nsubjecttothe\nrequirementsoftheASTAct\nPromotinga\nhealthyenvironment.\nmet\n2016 inan\nthe\nASTs\nbeen\nASTsare\nWVDEP\n\n<<<PAGE 10>>>\n\nand itsassociated\nLegislativeRules.\nTherefore,WVDEP\nexpectsColumbiatofulfillitsAST\nregulatory\nrequirement\nincludingbutnotlimitedtothe\nregistration provisionsfoundatWVCode\n§22-30-4.\nHowever,if\nColumbia\ncontinuestobelievethat its tanksare\nexempt,it should\nprovideany\nfurther documentationto\nsupportits\ndiscuss\npositionwithin\nthirty (30) daysof\nreceiptofthis letter.
