Dear Mr. Moss:
This will acknowledge your letter of February 1, 1972, in which you petitioned for a waiver to
exempt waster meter type gas system operators in the State of South Carolina from the annual
reporting requirements of Paragraph 192.11(a) of Title 49 of the Code of Federal Regulations.
We cannot grant a waiver to the operators of only one State unless some circumstances exist
which are unique to that State. Since this does not appear to be the case in South Carolina, your
petition for waiver cannot be granted. However, we are considering your petition as a petition for
proposed rule making to be applicable in all States. As indicated in the preamble to our recent
amendment to Section 192.11, 49 CFR, we plan to issue a notice of proposed rule making aimed
at developing new reporting requirements and forms which will be more appropriate for small
operators.
This matter is presently being reviewed by our Regulations Division and our General Counsel.
You will be advised as soon as possible regarding this proposed rule making.
