The\namendment becomes effective August 1,\n1977, and in accordance with\n?195.100, applies to pipelines\nconstructed, replaced, relocated, or\notherwise changed on that date and\nthereafter.\nAs a basis for the petition, API\nrefers to ?195.406(a)(1) which\nrequires that the operating pressure\nof a pipeline may not exceed the\ninternal design pressure of pipe\ndetermined in accordance with\n?195.106. API points out that\n?195.406 applies retroactively to all\nexisting pipelines, including those\ninstalled using the existing design\nfactor of 0.72. As a result, API\nstates that ?195.406(a)(1) could be\ninterpreted to require a reduction in\noperating pressure for pipelines not\ndesigned using the new factor of\n0.60. Since the rulemaking in Docket\nOPSO-35 with respect to ?195.106 was\nnot intended to require a reduction\nin operating pressures for existing\npipelines. API suggests that the\nmatter be clarified.\nThe Materials Transportation Bureau\nhas reviewed the problem raised by\nAPI and interprets ?195.406(a)(1) as\nprohibiting a carrier from operating\na pipeline at a pressure higher than\nthe\"internal design pressure\" which\n?195.106 requires to be determined\nduring the pipeline's design phase.\ndal\\195\\406\\76-10-15\nThus, ?195.406(a)(1) only applies to\npipelines to which ?195.106 applies\n(i.e., pipelines which are\nconstructed, replaced, relocated, or\notherwise changed on and after April\n1, 1970, the effective date of\n?195.106). Likewise, the limit on\noperating pressure under\n?195.406(a)(1) as a result of the new\ndesign factor of 0.60 in ?195.106\nonly applies to pipelines which are\nconstructed, replaced, relocated, or\notherwise changed on and after august\n1, 1977. Where ?195.406(a)(1) is\ninapplicable, one of the other\nstandards in ?195.406(a) would govern\nthe maximum allowable operating\npressure.\nTherefore, the petition for\nreconsideration is hereby granted to\nthe extent that the above\ninterpretation clarifies the\nreference to ?195.106 in\n?195.406(a)(1).\n(Sec. 6, Pub.
