This refers to your memo of October 20, 1978, concerning the exception for "public road
maintenance activities" in the Georgia law relating to the prevention of damage to underground
pipelines.
The definition of "maintenance" in Section 95A-104 of the Georgia Code of Public Transportation
supports our view of June 19, 1978, that the Georgia damage prevention program qualifies as
"program" within the meaning of 49 CFR Section 192.707(b)(2)(ii).
