Box 2220\nHouston, TX 77252-2220\nDear Mr. Hatley:\nThis responds to your letter dated May 29, 1992, requesting our\nopinion of proposed guidelines to be incorporated into your\nPolicy and Procedures Manual for filing a supplemental report\nrequired by 49 CFR 195.54(b) for changes in information\npreviously reported or additions to the original accident report.\nYou asked that we respond with a statement that either affirms\nour concurrence with your proposal or lists acceptable DOT\nguidelines.\nThe guidelines proposed by your letter set minimum thresholds\nthat must be exceeded to require filing of a supplemental\naccident report. For example, for damages less than $100,000,\nthe change in the original estimate would have to be 100 percent\nbefore a supplemental report would be filed.\nSection 195.54, Accident reports, requires an operator to file a\nsupplemental report whenever the operator receives \"any changes\"\nin information reported in or additions to the original report.\nYour proposed guidelines would not satisfy this regulation,\nbecause, by specifying minimum thresholds in the size of the\nchange in the information previously reported, the guidelines\nimplicitly permit changes in information below the stated\nthresholds to go unreported. This would contradict the specific\nrequirement of ?195.54 that an operator file a supplemental\nreport for \"any changes\" in information reported or additions to\nthe original report.\nTherefore, we cannot accept your proposal.
