Rule 321(1) contains the same requirement as 49 CFR 192.321(a)\nwhich is that plastic pipe must be installed below ground level. Although our response is beyond\nthe 60 days from written notification as prescribed in 49 U.S.C. 60118(d), we believe that a\nresponse should be provided.\nWe have reviewed the July 19, 1995, waiver application from Consumers Power Company and\nthe Commission's September 21, 1995, order waiving compliance with Rule 321(1). Based on the\nfacts in these two documents, we see no reason to object to the Commission's decision to grant\nthe waiver.\nSincerely,\nRichard B.
